Partner /spouse visa 801:onshore
Hello everyone,
Seeking some advise around submission of 801 visa, anyone who has recently submitted ?please share info
Circumstances-Partner is British currently in UK and has a E visa 651 with 3 months left on it hoping to lodge before this expires.
We are newly weds please help with questions below
-We planning for him to come then we lodge the visa on shore from what i gather we can do this.
-Is there a direct link that provides list of evidence required or the actual copy of the form so we can look at.
-will partner be allowed to work once we lodge visa and he is on bridging visa or we have to wait for grant.
-We have never lived together in the 3 years our relationship apart from visits between UK and Australia
Any info will be appreciated

As you can see, the process is usually 820 for 2 years (temporary visa), followed by the permanent 801.
Under the details of the 820 visa, you can find a step-by-step guide that includes evidencing your relationship.
I think once on the bridging visa he will be able to work or apply for work rights (not sure if it is automatic - hopefully others will be able to help)

Information on spouse visas can be found on the immi website - https://immi.homeaffairs.gov.au/visa...artner-onshore

As newly weds with no history of living together I suggest you provide as much evidence as you possibly can for how you kept in touch while apart, and things like transfer of money while apart, plus details of every time you managed to get together.
You'll get the 820 at first, then 2 years after the application for that, you can submit the extra evidence for the 801.
You will get working rights once the application for the 820 is lodged, and this should show up on VEVO.

Further to what Sparkles has said about the details of the evidence, if you also search back through the forum for Spouse/Partner visas you will find a wealth of information. Some of the threads are quite old, but the information about types of evidence will all still be current and correct.

Hi Pollyana
Hubby is now on shore with e651 visitors visa, how long do we need to wait before launching a partner visa. Do we need to wait for the full three months or we can to it straight away

It MUST be lodged while the E651 is in effect! Don't wait till the end of the 3 months or your partner will be unlawfully in Australia.

You can apply whenever you like; sooner is probably better than later as you don't want to leave it till the last minute, find you are missing a vital bit of paperwork, and then be unable to lodge it in time.
