Re: Parter Visa (Subclasses 820 & 801)
Hi Guys,
Myself, my partner and our young child are hoping to relocate to Australian fairly soon and I just wanted to run the plan we have by you all to make sure we haven't made any mistakes!
My partner is an Australian Permanent Resident and we have officially been in a relationship since October 2009 and we flew to Brisbane, Australia Feb 2010 for 12 months (I had a working holiday visa) and returned back to the UK in Feb 2011. Since then we have been living together in various rented properties, we have all the relevant evidence to prove our de facto relationshsip ie. utility bills, bank statements for our joint account, pictures etc. and we have also welcomed our first child into the world June 2012.
We plan on gathering all the relevant documents needed for our visa application and flying to Australia March/April using basic onlne tourist visas which last 3 months at a time. Within the first month or so we will then put forward our application for myself and our son. I understand because we have a dependent child together and also due to the length of time we have been together, we should automatically be granted permanent residency rather than having to go through the 2 year temp.
I have also read that you are allowed to apply for another visa whilst on a basic tourist visa and that if the application is still undecided when the 3 month tourist visa ends, your CO will be able to arrange a bridging visa until a decision is made.
I'm just basically looking for confirmation that all of the above is correct and that we will not have any major road bumps along the way. I understand that it is more expensive applying for a partner visa in Aus and that a lot of people would question why we do not apply from the UK but we would like to be residing in Aus as soon as we can.
Thanksss

When does your partner's PR visa expire? As long as that is still valid, your only concern that I can think of would be that if immi suspect you are not entering as a tourist you could be refused. But I don't have any experience of partner visas, I'm going on what I've read here so someone else might have a different view
