Default Overseas Student - Queries

Hello,

I have a few queries on Skilled–Independent Overseas Student (Onshore
General):

1. There's been some noise that the current rule of 120 points
(applicable from April 2005) may be extended by a few months to
accomodate the transitional students who will finish their studies in
July 2005. As a similar arrangement happened the last time when the 1
year study rule was extended to 2 years study, and students with 1-1.5
years courses were allowed to transit under the new rule. Is there any
possibility of something similar to happen for the points scale for
students finishing their course in July 2005?

2. Can I apply for PR while I'm under the regional visa (SIR), if I
happen to accomplish 120 points in the meantime?

Anything's possible - but don't count on it.

You are not being clear in what you are asking.

Pass mark for SIR is 110, not 120. Graduating students can apply for SIR onshore in some circumstances, offshore in others.

Once you have SIR visa you can't reapply for a regular 136 visa for at least 2 years, if that's what you're asking.

Your questions indicate a high level of confusion - you are strongly recommended to obtain professional advice if you are serious about getting your application right first time (you've no second chance).

I don't think anyone would be in a position to answer your first
question, outside of Federal Immigration officials in the know.

As for the second query, George Lombard recently ruled out that
possibility elsewhere in this ng. SIR apparently locks you into one
particular path for PR.
