Default Non-migrating child with learning difficulties?

My partners oldest son does not know whether he wants to emigrate with us. He lives with his mother.

The trouble is he has learning difficulties. It seems that they are quite severe, as he has not attended school for over a year and social services are arranging for him to have home education. He is 15. As much as I'd like him to move - I think having him on the application would go against us, while he is still at school. Also I have a feeling that he would change his mind about going at the last minute anyway.

But even if he doesn't come with us, he will need to have a medical. Will this go against our application, given his problems?

Yes, it could do.

Strongly recommend professional advice. Try Peter Bollard or George Lombard (search forum for contact details).

hi
in my opinion, having a child with a LD could have a huge impact on your visa application, have you put your visa application in yet?
if you want more info from me regards this PM me

Hi Sean - I would appreciate any info you could share. It is unlikely that he would be moving with us, but I gather he would still need a medical. Is there anything we could do to prevent this from affecting our immigration? Thanks.

All depends on the level of learning difficulties, our son has a poor reading age and general developmental delay, but agent doesn't think it should be a problem, doesn't need special care or benefits and doesn't have any behavioral problems, but does attend school full time. May be a problem if DIAC think he would be a drain on resources?

Just what we've been told with regards to our son
