Question Ex partners parental rites

I currently live in Perth and my fiancé is moving over with me in July from Scotland on a defacto visa! Up until now her ex has been fine but has started playing hardball with her 9 year old son! He recons he has the power to block the move? Does anyone have any info on the subject?

They where never married and he only recently had himself put on the birth certificate!

Have a look at the wiki. Looks like there's no problem if the child was born in Scotland, unless there's a parental responsibility order or agreement in place.

The father could apply for a parental responsibility order...

The child was born before the cut if date before the law was passed so!

I am not trying to be argumentative, just giving a "heads-up". Although the child was born before the cut off date for an unmarried father to automatically have PR, this does not prevent him from applying to the court for a PR order.

In my opinion, much better if the parents work it out amicably between themselves.
