I would recommend you seek the assistance of an immigration lawyer, if this is so important to you. Are you prepared to go to court over it?

Old Australia immigration web site contain this wordings, but new web site no such wording, does it indicate there is no such discretion now?

Than just sit the bloody IELTS and stop whinging about it. Lots of people had to take the test and you have said that English is not your first language, so just do what you need to do.

I agree with Dorothy just sit the test or give it up, theres no point moaning about a system you have no power to influence or change.
