Question Ability to invite my boyfriend

Dear All,

I am Student in English course here in sydney, I'm middle eastern and my boyfriend is middle eastern also we were 2 years together as you know its hard to live together in middle east and its danger to say that you are gay since this is not acceptable there... please help me us I can invite him here and grant to another visa to let him join me and live here under freedom gay life umbrella in sydney please advice me if it possible and how can I start..?

Hi

You do not say what visa you are on exactly. If you then look up that visa on the DIAC website it should tell you about adding people to the visa. I guess your boyfriend would be de facto (same rules for heterosexual and homosexual couples - no discrimination here). I would suggest speaking to an agent though.

If you just mean for him to visit as a tourist then I guess you can invite him (if this is a requirement from your country) like any other person- but it won't be for long and he will not be able to work at all.

Maybe if you give more details about your visa and what you hope to achieve then someone can give a more precise answer.

A student visa isn't a permanent visa, so you can't migrate on it. You will need to look at a path beyond studying in order to actually migrate. Its also pretty difficult to add a de facto partner to a visa without living together for a certain length of time.
I would suggest professional assistance from a registered agent as you will need to present the case well to DIAC in order to overcome the fact you haven't lived together.

we lived together for 9 months when we travelled to another country and we still in our relationship since 2 years ago

But you don't live together now. And 9 months is not long enough to prove a defacto relationship.

Can he come on a holiday and visit you for a short time? If you want to sponsor him/add him to your application then you need to have a visa which will allow you to do that. Unfortunately a student visa is not a permanent visa, so you cannot sponsor him on it.

At least at the time when I applied for a student visa gay people could not apply together. There were a couple on here who both had to come here to study to be together. I have a feeling that may have changed in the last 3 years though.
I would also be contacting your migration agent, as to be honest I don't think they will count it as a defacto relationship as you have to have lived together for a year as a couple. You need someone with experiance for this one.
I would guess that your only option would be to have him come over on a student visa, and then when you have finished your course, if you qualify for a perminant visa, and you have been living together for a year, THEN add him to your perminant visa application.
