Default 457 to ?

hi,
I have recently been made redundant on a 457 visa and my wife is almost completed her registration exams for physiotherapy.She as 1 more exam on march 5th 2014 and if passed she will be full registered in Australia.The problem is our 90 days falls short by 8 days is there another visa we can aquire to bridge this gap.tks

Well even if she had finished her exams, I am not sure how that would help you? She isn't going to get a visa the day her exams finish..?

You or her need to sort put an alternate visa,such as finding another employer sponsor. Or if she is studying, perhaps a student visa?

maybe theres an alternative visa to bridge the gap while we wait not sure if I can get another job in time could we possible get a bridging visa.We will be applying for a permanent visa once she passes last exam!!!

No, you cannot just get a bridging visa. Bridging visas are something that just happen when you apply for another substantive visa. So you need to work out what substantive visa you can get.

And there is no need for multiple exclamation marks. But my point is that you are not going to be able to apply for a permanent visa the day your wide passes the last exam are you? What visa would that be?

im sure there is a visa of some kind available to bridge the gap but then again I wouldn't be surprised if there wasn't!!!Been here for 5 years and messed around in that period by companies and immigration changing the rules when they feel like it.We will wait and see what happens im sure something will be available!!

If you were made redundant at the end of November, your 90 days will expire near the end of February - at which point you will have no visa allowing you to stay in Australia and will be illegal. If you cannot find another job, you need to be ready to leave the country, or find an alternative visa to apply for as BS suggests - Student for example. If you have applied for a student visa, but no decision has been made when the 457 expires, then a bridging visa would be possibly put in place but I don't know enough about bridging visas to comment. In your situation it may be worth getting advice from an experience MARA registered agent.

Yes, there is a bridging visa to bridge a gap. But it does need a visa either end, otherwise what gap are you bridging. So you need to work out what visa are you applying for. You can't just get a bridging visa as a place holder until you find a visa to apply for.

Waiting to see what happens is a terrible visa strategy. So just to be clear, you CANNOT apply for a bridging visa. You must work out what visa you might qualify for and apply for that visa before the current one is cancelled.

my wife isn't a student shes qualified physio just doing the registration exams.We may contact a lawyer for more advice on the matter tks for your help.

That would be a good idea. Much better than waiting and seeing, as I think you are in a serious predicament if you do not come up with an alternative soon. Can you not apply for skilled migration?

No im over 5o yrs old and don't come in the special income bracket so will wait for wife to take her profession forward.tks
