Default Work Permit at POE

Hi
My husband has received at positive LMO and a contract of employment to work in Canada. Can we apply at the POE for his work permit and our temporary visas? We are a family with three children aged 7,5 and 2. The confusion seem to be with our 7 year old needing an open study permit. Has anyone applied at the POE with children? Where there any issues?

As long as your husband does not need a medical for the job he will be doing here in Canada - you CAN apply at POE and you will receive work permit/open work permit and study permits then and there. The Border Services officer will decide whether your 7 year old needs a study permit - some will issue them, some will not.

And just to add to AD's excellent reply, him being able to apply at POE also depends on his nationality - assuming he's a UK citizen that's fine.

Even if you are not from select countries who dont need visa to enter canada, you will be able to apply for WP at the border (mostly). I am from one of those non countries and applied for Work permits at border nearly 3 times.

My daughter who is 4 year old was issued a Open Study permit with out any issue, and they didnt charge for it.

In which case, you've been lucky, as those from countries requiring a TRV are not supposed to be eligible to apply at POE! See the following info from the CIC website:

"Some workers can apply at a port of entry

Most foreign workers must apply for a work permit outside of Canada. However, you may apply for a permit when you arrive at a port of entry in Canada if:

•you are from the U.S., Greenland or St. Pierre and Miquelon;

•you do not need a temporary resident visa (TRV) to visit Canada and your job does not need a labour market opinion from HRSDC;

•you will not be working as a live-in caregiver or as a seasonal agricultural worker;

you do not need a TRV to visit Canada, your job requires you to have an HRSDC labour market opinion and it has been issued by the time you arrive."

Yes I think I am lucky in that aspect. I am from India and never had issue with getting the WP at POE, did this twice. Once we went with some paper work that was not in line with what the Immigration officer was expecting, the officer actually explained everything and let us in with out any issues and we went back with all the documents later.

We were able to get the WP with updated documents at POE, it was a breeze.

Im betting that the TWP was initially issued by the consulate and you were given a letter to give Immigration on arrival as citizens of India require a TRV. Yes you got the TWP at the border but it was already approved and in the system and the letter was issued in order to activate the TWP.

Nope, nothing has been done at the Consulate. We got an LMO when in Canada, then applied for TWP and SOWP at POE. We already had visa to travel, so we were able to travel to the POE and back into Canada.

Same story next two times.. never had anything to deal with Consulate regarding the Work permits.

Sounds like you've been lucky enough to get immigration officers that don't know their own rules!

But it's not a route to recommend to others, as they may well be turned away, CIC's rules are quite clear on who can apply for TWP at POE, and those that require a TRV are not eligible.
