Default Work Permit : Pl Advise Mr.Miller

Mr.Miller,

My case is of a laid-off workpermit holder. My application for
Permanent Residency is in Process( Medical exam over in Nov02 after
interview waiver). My question is, can I apply for open workpermit to
support my stay here in canad till I get my PR? I am asking this
question because if spouse of skilled worker can have a open work
permit to work why not the laid-off skilled worker himself can't work(
with PR application in process). Please advise me.

If you got laid off then you don't need to remain in Canada till you get
your PR and you may return to your home country - it is by your choice only
to remain here. Law doesn't allow for open work permit in such
circumstances.

I agree with Your first line - it is trivial choice to remain here or
to go back. But what do you advise on the fate of Immigration Process(
at the advanced stage)? - To drop it or to transfer it?

I only wanted to know about the possibilities in such circumstances,
your 2nd sentence answered that.

Why transfer? If case was filed in Buffalo then it doesn't matter where
you'll stay as long as you can enter US if interview is required.
