Some questions for Mr Miller
Dear Mr. Miller,
1) I have done my MBA in Canada from one of their leading programs,
and have worked here with some of the leading firms for about 8 months
till date-do I still need to take the IELT (English poficiency test)?
2) I have the points (around 81 under the new system and am currently
employed after my MBA-I have applied for PR in Feb 2002 and got AOR on
July 2002-my employer wants to know if there is anything they can do
to get teh PR faster-my job is not technical in nature.
3) My work visa expires in April 2003-what should I be doing in the
meantime-assuming that my PR won't come before that?

1) Immigration Manual tells processing officers that in the case when applicant
was raised, obtained education and gained work experience in the environment
where English was predominant language then simple written submission will do.
Unfortunately it is not your case as you only earned couple years of education
and gained less than a year of work experience here. So, in the absence of
IELTS results officer must evaluate a substitute evidence against Canadian
Language Proficiency Benchmarks. Only if such evidence is fully conclusive and
proves beyond any doubt moderate or high proficiency in English appropriate
number of points will be awarded. But note that such evaluation will be very
subjective as officers really don't like going through 200+ pages of Benchmarks
manual just because you didn't want to provide IELTS results, so don't expect
getting maximum number of points. In your best interest is to pass IELTS or
CELPIP test.
2) No, your employer can't help you here, nobody can.
3) I don't know, it is your decision what you want to do, as long as it is
legal.

I do not believe that your problem is one of points or English
language ability but one of time. I suggest you start by having your
employer seek a confirmation of offer of employment on a temporary
basis and extend your stay in Canada until your case in Buffalo is
finalized. You have to bridge your time from a post graduate work
permit to PR status and this will be the only way as you cannot extend
your WP on the same ground for another year.
