Settlement Of A Class Action Lawsuit
any information about the lawsuit for the pre 2002 applicants??
quoted from CIC
At that time, the Court will consider any objections to the Draft Settlement Agreement which it has received from Class Members. The Court may make changes to the Settlement Agreement at that time. The final Settlement Agreement will be posted on www.cic.gc.ca by not later than March 18, 2005. You should review the final Settlement Agreement on the website shortly after March 18, 2005.

# All applications submitted in 2000 will receive selection decisions within 24 months of final settlement, regardless of visa office;
# All applications submitted in 2001 will receive selection decisions within 42 months of final settlement.

Seems like. Providing of course that CIC will not terminate the agreement as per Article 10. If 5,000 or more of affected 100,000+ applicants opted out then CIC has the right to terminate agreement without any further consequences. Final number of those who opted out will be known sometimes in April (on or after April 4th).

Nothing. It will be a completely new problem. But as you can see from current law which has been approved and implemented with retroactivity fully build in:
http://www.canlii.org/ca/regu/sor2-227/sec77.html
and with that retroactivity already challenged in Federal Court which dismissed those claims I don't see a situation when government will make any room for challenges. Bur hey, you never know...
