Default Refusal of Visitor's Visa Extension??

Hi everyone,

I hope someone can PLEASE help: My sister's BF is currently visiting in Canada and applied for an extension of visitor's visa. The application was refused and he received a letter stating: "You are now out of status and must therefore leave Canada by June 24th, 2011."

Does this mean he needs to leave BEFORE June 24th or can he leave on June 24th? If he leaves on the date given, is this too late??

Sorry to hear this. What did the office advise when he called to confirm?

Given that the letter says he is now out of status, it sounds like it would be wise to leave as quickly as possible. In my experience, the phrase to do something by a given date means, it's too late to do it on the following day. So he needs to be off Canadian soil by midnight of June 24. That's only my opinion, though.

Well - did it give you the option to apply for a restoration of status??

If you can provide enough informaiton to the Canadian Government - and you apply no more then 90 days after your status expires, you may be able to stay.

My husband's visitor extension was denied because we failed to provide enough information on when he came to canada - (we forgot the stupid page with his passport stamp in it) so we applied for a restoration - we are currenty waitingon the outcome of that, if it says NO - he will have to leave. According to the CIC website - he can remain in Canada while awaiting the outcome of that decision. We applied for the restoration through a mailed application to prevent any mistakes from happening - problem is...it take a LONG time to process a mailed application.

Good luck, i know its stressful - just breath and know you have options. The option of restoratin does cost 200.00 but read the applicaiton carefully make sure you provide everything they want.
