Points assessments? Is it going to be the same even after 67 pass marks
Hi Mr Miller and Experts
I wanted to find out whether the points assessment going to change
after the reduced pass marks from 75 to 67? I am asking this because
before when the pass marks used to be 70 then the points assessments
were different from the ones we have now after it changed to 75 marks
as passed. So is it possible that Canadian immigration is again going
to change the assessment also for the 67 pass mark?

Only the pass mark has been adjusted, nothing else. Selection criteria and
points grid remain unchanged as per new law implemented June 28, 2002.

What would happen if someone with 67 submitted visa apps and then the
department comes back with a new 70 point threshold

department comes back with a new 70 point threshold

If pass mark changes then it will apply to all pending cases as well -
exactly like it has been applied on September 18th.
So, if someone with 67 points applies today and pass mark goes up to let's
say 70 points before s/he is approved then of course case will head for
refusal. Law is quite clear about that and retroactivity is here to stay as
far as I know. Law requires applicants to meet selection and other criteria
(including pass mark) that are in force not only at the time of application
but also at the time selection decision is made and at the time of visa
issuance.
When criteria (including pass mark) change in the middle of the process then
it is irrelevant that application met criteria at the time it was
submitted - case must meet new criteria that are in place when selection
decision is made and when visa is issued.
This is why I strongly advocate here in past 2 weeks that everyone with
score between 67 and 72 or so points should make everything possible to
improve the score as fast as possible after submitting application in
anticipation of higher pass mark. It is always better to be prepared than
sorry...
Of course pass mark may stay at 67 points level for another year or longer
and many with 67 points may get through if it stays for that long - but
unfortunately there is absolutely no guarantee that it will stay at this
level for any period of time and it may be changed next month, 6 months from
now or even tomorrow...
