Default please give a hand, Mr. Miller and other experts

Dear Mr. Miller,

My brother in-law, applied for the independent immigration in Berlin office of Canada last June. Last Friday, his status on CIC E-Client was changed to "Decision Made". Today, to his surprise, he received a rejected letter from Berlin. The reason is that he has insufficient points according to new regualtion. It is very strange that Berlin office gave him zero point on his adaptability, and 16 points on his English language. He therefore got 72 points less than 75 points, and doesn't meet the new regulation.

In fact, he obtained a M.Eng from Germany, and has near 10 years working experience in Civil Field. Also he passed CCPE assessment last year. His wife, my sister has a three-year diploma in Chemistry. At least, he should have more then 3 points on his adaptability. And, I doubt why the officer just gave him 16 points rather than 24 points on his English language without any evidence such as interview or English test.

We now all are very uncomfortable for this result, and want to put forward our opinions to Embassy in Berlin. Mr. Miller, could you favorably give us assistance on this matter? If needed, we would rather seek a help from consultant or a lawer, than accepted this unfair result. We really don't understand why the embassy just sent him a rejected letter directly instead of a chance for interview. Once again, please help him to solve his sorry plight, Mr. Miller. Thanks a lot.

First of all - maximum number of points for one language (English or French)
proficiency is 16, thus officer awarded already the maximum. The maximum
number of points for proficiency in both languages is 24.

As for spouse's education - if it was well documented and qualified for
points then officer made a mistake by not awarding any. If this is the case
then there is a good chance to have it corrected with proper action. But
nothing can be done without full assessment of the case, entire application
package and CAIPS file with processing officer's notes.

CAIPS - computer assisted immigration processing system. It is a system
where all information from the application, points awarded, tasks performed,
decisions made and processing officer's notes are entered during the
process. It is vital to analyze CAIPS file together with the copy of entire
application package before any next action to be taken. I received your

In this case, apparently, without English test score seems no
problems. But the spouse lower educational level does. If the spouse
could provide some degree, the principal would have no problems. Alas,
the principal now must get help from the spouse. That is the new law!

Canadian law prohibits release of information pertaining to immigration
application to anyone who is not in Canada, thus person residing (or company
operating) in Canada must apply to CIC in Ottawa for the copy of the file on
applicant's behalf. Process takes anywhere from 3 to 6 or so weeks for just
CAIPS printout and about 90+ days for the copy of entire file, depending
from the current workload in Ottawa. Note that in most cases visa post
processing the application is asked for approval to release the information
and what can be released - not everybody can get uncensored printout as in
some cases certain information can legally remain undisclosed.

procedure? Thanks.
