Default Mr. Miller.. I Need u Advice!

HI Mr Miller or guys

I am a Canadian Citizen and I had sponsored my wife (US Citizen) to
Canada. She is planning to land next week.

Since she has a good job in US (working for airline, and the company
needs her) while I am unemployed in Canada (because of the bad economy
in Canada for IT jobs)

She will be landed and go back for work after 4 days? I know she has
to meet the requirements for Canada PR status (must be in Canada for 2
years / 5 years). After she is gone, she will file K-3 from US for
me. So I look for jobs in the US.

The problem is.. Can I leave Canada to US? Since I am Canadian
Citizen and my wife's responsor. Do I don't have to be in Canada..
But I will file income tax! My wife will try to meet the Canada PR
status requirement over the 5 years period. She wants to keep the
Canada PR status. We will live in my sister home in Ottawa and we
have all ties in Canada as well.. Like bank account and family..

Is that do able and what is your advice?

There is absolutely no problem here. No ties to Canada needed. Your wife
must only meet residency obligations (730 days in Canada in ever 5 years) to
maintain her PR status. Days of her absence from Canada while accompanying
her Canadian spouse abroad will be counted as days of presence in Canada
anyway for that purpose, although not for citizenship eligibility.

For the question about you being able to work in the US, I would recommend
that you join the newsgroup alt.visa.us.marriage-based.

It will probably be something like 9 months or more after your wife files
the K3 papers before you will be allowed to work in the US.

But how do you proof for date remain in Canada? If not carrying maple
leaf card for traveling document?

PR Card is not a proof of meeting residency obligations. You will have to
show other evidence - lease/rental agreement, utility bills, bank statements
showing use of your bank and credit cards in Canada in days claimed, etc.
