Moving to Canada under PR and consulting with American Company

Default Moving to Canada under PR and consulting with American Company

Hi All,

I'm French, currently on H1B in the US. I'll be moving to Canada soon as a
Permanent Resident and open my own IT consulting company. I already have a
client based in the San Francisco area, and will continue to do business
with him.

1- Payment/tax issue: my understanding is that I will send them an invoice,
and they will send back the payment through a wire directly on my Canadian
bank account. Can I keep a bank account in USD in Canada? Would this save me
some money when avoiding to change into CND? Will I then be able to change
this money into CND at any time? Will I be able to pay myself in CND? Is
there any fees associated with this? Will I have to declare the CND or USD
amount to the Canadian tax office?

2- Travel: I will need to travel from time to time to San Francisco to visit
the company I'm working for. That's where it's getting a bit blury as I will
be conducting some kind of business with them but under the Canadian company
umbrella. This won't be actual coding or anything, but simply meeting with
my client, building relationship, go to a restaurant in Napa, etc.. ;-) ...
I'm suspecting that I need to have my case pretty well nailed down in order
for me to enter the country as the US customs may suspect illegal work and
immigration... Anyone has some advices on this?

Julien,

I have a similar circumstance as yours. Let's keep in touch on this matter
as I have been doing some research on this.
I am landing next month and will continue doing some works for the US
company in bay area where I am currently a fulltime employee, but will soon
be working as consultant after my official move to Canada next month.

I have a question though, I sort of thought about this. To facilitate the
occasional travel down to SF, can't we just keep our H1B status? I don't
suppose H1B holder must reside in the US?

Mr. Miller,

I understand citizenship rule that I have to accumulate 3 years of physical
residency in the preceding 4 years to be eligible for applying the
citizenship.
However, for the purpose of citizenship eligibility, besides residing
physically in Canada, do I have to work for a local Canadian company during
these 3 years (with proof of Canadian Tax Return)? My plan is to work
remotely/telecommute for a US company from within Canada, during which, of
course, I will file for Canadian income taxes. I just want to make sure it
won't cause any significant issue during citizenship application.

Well, I thought about this for the H1B, but it is plain illegal, as once we
quit our job, the visa is gone too... we got to convince our former boss to
not tell the BCIS that we left, which is illegal also, and then we got to
cross our finger that the IRS doesn't catch up to quick with BCIS on this
matter...

*Most* people would simply have taken the easy way out and used the H-1B to
re-enter the US.

True.
If the job no longer exists, irrespective of whether the employer has
cancelled the H-1B petition or not, you cannot use the visa to re-enter.
In fact, even if a job exists and you enter on H-1B but do not report for
work, you are out-of-status.

Once again, it is refreshing to see someone who deals this fairly with law
authorities.

In my opinion, it's easier to work with the system than against it...
there's always a way, just need the time and resources to find it... ;-)
