Married couple and IMM 5409 Statutory decl of common-law union
We are married and living together.
We are sponsoring parents.
Can you please tell us do we need to fill 5409 Statutory declaration of common-law union ?
Or
Do we need to provide copy of marriage certification.
I am confused because I think instruction is not very clear.
Can someone please reply soon.

Hi
1. Read the document checklist IMM 5771
2. If you are married, you don't require the 5409 you require a copy of your marriage certificate if your spouse is a co-sponsor.
3. You need to send a copy of your long birth certificate showing the relationship to the parents.

Common-law means 2 people living together but not married. They have to provide proof that they really having been living together as if married for a certain period of time and not just room-mates or flat-mates., eg by supplying house leases in their joint names, joint bank accounts, wills, proof of holidays together (eg photos)
Married couples have to supply evidence of marriage. It is assumed that they will be living together.
So you declare one or the other!

CIC defines common-law partner here for spousal sponsorhsip.

It is very clear in saying common-law partner is not married to you.
This also confirms with your replies.

I'm glad that you've found that we agree with the CIC definition!
Otherwise, I would have been wrong in my understanding for the last 50 years!
