Sponsorship of spouses is not dependent upon the LICO. You will be asked for
financial information but its not a factor. Jim Humphries, former visa officer

You must complete the financial information but you will not have to = meet the LICO
in spousal applications.
There is always a chance any application will be refused. Prepare it = well, complete
it fully providing all that they request and you should = not have any problems.

Don't worry about the low-income cut off table if you are sponsoring your spouse. All
you need to do, i believe is to not be on social assistance, your actual income is
irrelevant. Although you still have to complete all the financial sections of the
application forms, including everything anyone else would, but if your income falls
below then it will not exclude you as in other cases. As for her visiting you after a
submission, as far as i am aware this is not illegal but is up to the discretion of
the border immigration. She will have to convince them that she does not intend to
stay in Canada and will leave again. This can be difficult if you are apllying to
live there as they see on one hand you want to live there, and on the other hand you
are saying you will leave. Im sure though that if she can show she has a job to
return to or studies and a return ticket or so forth and that she would need to be
back in the USA to complete her PR application and receive her visa etc and explain
that she wants to visit her husband then it should be ok. if she wanted to be in
Canada before the Visa came throug, then she would have just moved there with you
first and applied from within wouldnt she?

In the case of spousal sponsorship applications, income requirements can generally be
overlooked as long as the sponsor is able to demonstrate that support is otherwise
possible. Additional information on this topic may be found at Campbell, Cohen's web
