I am Canadian. My husband is applying for PR so we can move to Canada. What if he is
refused? Can he move to Canada anyway if he doesn't work? He has US medicare so we
can come south for medical treatment.

Thanks very much.

Why do you think he is going to be refused. Why not cross that bridge when you
come to it.

Based on your mention of US Medicare, I wonder whether a medical condition makes you
worried that PR may not be issued for your spouse. In such a circumstance, I believe
that you could look into getting a Minister's Permit for your spouse.

You have to be found inadmissible as a PR before consideration would be given to
issuing a Minister Permit.

Thanks for the help. We have crossed all the bridges, except for the medical. I don't
know the criteria on which he might be refused PR.

I think he fits into the second category, that is although he is in fairly good
health he needs to see a specialists occasionally for heart arrhythmia and for his
cornea transplant.

Yes, we will wait for a decision before doing anything drastic. Just like to be
prepared, emotionally.

Thanks, Barb

You have not said why you thinkhe would be refused. If you sponsor him, as you are
entitled to do, therre are no selection criteria, only medical and criminal
requirements. Even if you are living abroad a Canadian citizen can sponsor a spouse.

An employment authorization may allow an individual without permanent resident status
to work in Canada temporarily. Additional information on this topic may be found at
Campbell, Cohen's web site at the following URL:

Eligibility for temporary admission, however, can be negatively biased by a previous
refusal in a PR application.

Hi Jim,

It is only the medical that is in doubt. I don't know how strict the criteria are.
Does the person have to be in perfect health? My husband has a heart condition
which is well controlled with medication, as well as cornea damage from a
childhood accident.

Thanks,

Barb

We are not looking for permission to work in Canada, only to live there. I am
Canadian. My US husband has retired and we have more than adequate income to live on.
I can work if we want more money. At present we own two homes(one in the US one in
Canada) and a small apartment building in Canada. Plus savings and pension income
about 50,000 Canadian/yr. I want to return to my native land after living in the US
for 6 years. He wants to come with
me.
