Grandaprents Sponsership timeline -question
Hello All
We are looking for some advice, opinions or people in similar situations.
My wife's parents are currently being sponsored under family class to emigrate to Canada, they are currently waiting for their PR to come through, they decided against going for the grandparents super visa's when it became available.
The application was originally made in early 2008
They put application on hold in late 2009 for personal reasons, but it was never withdrawn, it was reinstated in early 2013, and allowed to go forward by CIC.
All fees have been paid and CIC requested Police Checks and medicals in Oct 2014.
There was no issue with the Police Checks, but there was a slight problem with one of the medicals, this was over blood pressure and secondary tests requested by CIC.
The family doctor said no secondary tests were warranted and wrote to the CIC telling them this.
We don't know if the CIC are happy with doctor's explanation/opinion, as the CIC have not written back or told us anything, despite numerous attempts via telephone to find out whether the medicals were an ongoing issue for the CIC or not.
For now we are hoping/assuming that the CIC are happy with the medicals.
No been no further requests for secondary medicals.
This was almost 6 months ago, in mid April 2015 the police checks will expire and we really still non-wiser about the acceptability of the medical.
I guess our question is, where are we in this process ? We think we are near the end but we are not really sure.
Thank you your answers in advance
Allan

Hi
1. I think that you will find that CIC is not that; interested in their personal physicians opinion, It is the Regional Immigration Medical Centre that requested the further tests,
2. I think if you want the application to progress your parents should have the additional tests by the Panel Physician, it is quite possible at this point they could be considering a refusal for failure to provide the requested medical tests.

Hello PMM
Thank you for the reply - Would the CIC not write to person in question and inform them, that despite their Family Doctor's opinion, that a further examination is still required.
Or is a refusal just issued without further explanation.
Regards Allan

Hi
1. In sponsored cases, they should (if the visa office is on the ball) send a "fairness letter" in which they should state their reason for a refusal. At this point, it would be up to the applicant to rebut this letter.
2. In your GPs case, if their medical was furthered, they should have just taken the furtherance letter to the Panel Physician and have the tests performed. Which is what they will probably have to do, if they receive a fairness letter and which to overturn the decision.

Hi PMM
Firstly, thank you for taking the time to reply.
We are now in the process of contacting the CIC via email to clarify the medical position.
However upon checking, it would appear the application is still in a Canadian Processing Center, which to us does not seem to make much sense, as when you check the information on the CIC website the final stage should be completed in London UK office. And I am assuming that this is the final stage as they have had the requests for medicals and police checks.
regards Allan

Hi
1. Not that unusual, CIC will process overseas applications in Ottawa to relieve some offices volumes.

Didn't CIC already tell them that they needed further examinations? Why would they tell them again?

So from that exchange between doctors we sort of expected some indication that the CIC were happy or not. We have had no indication one way or the other, so we have emailed today after several phones have proved fruitless.

HI
1. So they actual never received a medical furtherance from CIC? So my previous comments probably don't apply. The application is probably chugging along. Check their Ecas to see what it says, or have them authorize you to apply for their GCMS notes under the Acess to Information.
Unfortunately no not quite, that would have been to easy, the panel doctor suggested that further tests may be a consideration, the family doctor wrote back to them and said that there were no reasons to do a further medicals for blood pressure, as no symptoms were present or ever had been.

Sorry I didn't make that bit very clear, no they actually never received any firm instructions, just a recommendation by way of a suggestion/recommendation by the Panel Doctor to the Family Doctor. We have never had sight of any letters which were sent, so we don't know how it was written.
We hope the app is chugging along but we are not really sure, there is nothing on ECAS, but to be honest that does not surprise me, as when we came to Canada 7 years ago information only appear on ECAS in the very last few weeks.
We will be requesting the notes, if we can't get any where with the emails or they get a negative result for their application. I was aware that the notes could be requested, but we didn't know the process, we do now, so thanks.
(quick search using "GCMS notes")
Like lots of people on this site, our knowledge of immigration process is limited at best.
