File transfer if filed in Oct/2001 ?

Default File transfer if filed in Oct/2001 ?

Question to experts...

My company filed an application for PR on my behalf in Buffalo in
Oct/2001 - under old law regulations. At that time it was possible to
transfer a file in case if I cannot go in US fot the interview.
I know NOW Buffalo does not transfer files to another country offices.
But shouldn't my file to be processed under the law situation at the
time I filed it? Of course, I'am wondering that if they call me for the
interview - and if I cannot obtain US visa, that is possible - what to
do... As well as I know processing regulations should be based on the
Law that was in effect at the time of application filing date. But I'm
not quite sure about this particular situation...

If anybody knows some information, or examples from real life please
share... Full of worry

Applications received prior to 2002 were assessed under old law only until
March 31, 2003 - all pre-2002 cases remaining after that date are being
assessed under new law, although with lower transitional pass mark of 70
points.

Fact that you applied before the implementation of new law has no effect in
respect to file transfer. New law allows transfer only if such is not
harming or it improves integrity of the process.

It is in your best interest to submit as soon as possible new application
forms with updated supporting documents meeting new law's standards
(including proof of language proficiency) to improve your chances for
interview waiver.

Everybody appears to think that Buffalo will not transfer a file. The
problem is that there is no right to have a file transferred however
there is no prohibition. If you do not ask you will not receive!

In any event you appear to be presuming that you will be interviewed,
why not wait and see what happens before jumping to conclusions. If
you are in canada and working chances are you wil be waived.

Here is what is copied directly from Buffalo's web site:

"Answer:

If your file was transferred before 28 June 2002, you should allow 3-4
months for it to arrive at its destination. Under the new Immigration and
Refugee Protection Act, we no longer transfer files.
