Even bother applying w/ criminal history?

Default Even bother applying w/ criminal history?

I am a US citizen living in the US. I am putting together my documents prior
to applying under the Federal Skilled Worker class.

I have a common-law partner who has a criminal record. Twenty-seven years
ago, at the age of 18, she was arrested for being in the proximity where
marijuana was being used. She spent a night in jail, paid a fine and
received a 90 day deferred sentence. No other criminal arrests or
convictions since that time.

I understand she may be considered inadmissible to Canada because of this
"criminal" history. She will be putting together her documentation to apply
for rehabilitation....state police certificate, FBI clearance, etc.

In the meantime, can we go ahead and submit our application for Permanent
Resident status? Since the processing time at Buffalo is 2+ years, from what
I read in this newsgroup, we should be able to get the application for
rehabilitation completed and approved in the meantime. We would then send it
in to be attached to the PR application.

Is this a workable plan or are we wasting our time until the Application for
Rehabilitation is approved?

Or can we ask that she be "deemed" rehabilitated, since this offence
happened 27 years ago and there are no other offences since then?

In this case, as long as it's disclosed, there most likely wouldn't be
any problems because it was so long ago. And hey...if Ross Rebagliati can
be a national hero (albeit short-lived) then she should be fine. :-)
