Certificate of departure missing- advice needed
Wondering if anyone has been in a similar situation or can offer some solid advice.
On April 26th 2014, on a trip to Canada to visit my Husband (Canadian) I was stopped at the border (Montreal airport) and on being questioned by border officers was given a one year exclusion order due to an overstay on my previous trip. I have made 14 trips to Canada since 2008.
The border officers gave me 5 generic forms that consisted of the exclusion order and their and my signatures(2 forms) an additional report signed by them (2 forms ) and the departure order with a photo attached (1 form).
I've bought a return ticket for between the 27th April 2015 until July 14th 2015 to go back and spend some time with my husband.
I applied for spousal sponsorship from outside Canada and the sponsor part was approved July 31st 2014. London are dealing with my part of the visa. I had to attach ARC details to be processed along with the visa and I heard back last week the ARC was declined which is to be expected. The request for the ARC was a formality.
I was getting paperwork together for the trip to Canada and I can't find the certificate of departure anywhere- I've searched the house and the attic, It's gone. I still have the boarding pass from the flight between Montreal and London. From information I've gleaned from another internet forum and from info online is that I can re enter Canada if I have a certificate of departure - one was issued and all of the details are on the computer system that the border officers use. If they have that information to hand do I really need the piece of paper - All the paper does is confirm I left. They know I left, they arranged the flight and the officer whom I was dealing with escorted me through security and to the boarding gate himself. It is too late to get a VOS as they can take up to 6 months. Do I need to spend the next 3 1/2 weeks worrying about this?

The Exclusion Order is for 12 months from the date of your departure. Once that 12 month period has passed you are free to travel back to Canada without any paperwork but expect to be referred to Immigration Secondary.
The ARC was only relevant as you wished to return within the 12 month timeframe.

Re: Certificate of departure missing- advice needed
Thankyou Former Lancastrian! it was just the wording on the CIC website that got me worried...
Exclusion Order (form number IMM 1214B)
If you were issued an Exclusion Order and
•12 months have passed since you left Canada and
•you have a Certificate of Departure (IMM 0056B) showing the date you left Canada
you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.
I guess the certificate shows clearly on their computer.
THANKS AGAIN!

Hi
1. What it means if that you didn't receive a Certificate of Departure, i.e. didn't check in to CBSA on your way out, then CIC doesn't consider you to have left, and the Exclusion order would have turned into a Deportation order.
2. Since you checked in with CBSA and received the 0056, you will be fine.
