Default BC PNP common-law question

Please.. can someone help!!!...

My boyfriend and i are in Canada on a 1 year working Visa, which expires next week. We were just about to both send off out applications for PNP, when my employer changed his mind and backed out!
We have been a couple for four years, and living together for a year, here in Canada.
Can i apply as his common-law partner as part of his PNP application??? Or would i only be able to apply as his common-law partner, once he gets his PR status???

If i can apply now, as part of his PNP application, how do i go about doing that. I've looked on the PNP website but can't find mention of it. I can't call them because it is the weekend. I really need to get this figured out, as we have to leave the country on Thursday 9th!

Any advice would be great

i don't ask you why you started the whole thing at the last second - there's no joy in crying over spilled milk... but it would have been nice to get the one or the other additional information, like more details about your jobs (especially which noc)... type of working visa (i'm not sure if you are talking about bunac or a similar working holiday visa?)


but to business (assuming that you are applying under the skilled stream - noc 0, a, or b... the whole thing is going to look quite different if it would be a semi-skilled occupation):

the second line in part a of the nominee information form is for the name of the spouse. i'd say your name belongs there.

the checklist in addition asks for your cic forms: schedule 1 and additional family information form imm5406.

be aware that - although bcpnp state on their homepage that it takes 5 to 8 weeks to get a nomination through on the provincial level - they seem to have a backlog and nominations seem to take around 16 weeks. an other possible issue to consider would be that they have only a limited amount of nominations at hand per year (depending what numbers they were able to negotiate with cic) and they might have run out of them by now. i guess they put people on the list for next year if that's the case.


people on this board who included their partners in their bcpnp-applications (although they did that before the regulation update as of september 26, 2008... i hope the process didn't change that particular part...) would be live-to-ski or scottdrummer. (from the top of my head, there might be more...) if you still have doubts i can ask my work mate who included his wife in the application (bcpnp around a year ago) - but i won't see him until tuesday.
since i went through the whole thing as a single person and in early 2007, i'm sorry not to be able to be of more help regarding this specific question.

Thanks alot for you help..

Yeah, this is very last minute, but of course i hadn't anticipated my employer pulling out like this!

We were under the impression the PNP just needs to receive the application before our Visa expires?....Our plan is to travel for the 2/3/4 months whilst it is all being processed, the PNP already told us they could inform us via email..

In regard to them possibly not having spaces left this year, that wouldn't be a problem because we aren't anticipating being back until January.

Right now, we are here on a one year bunac visa. My boyfriend is a Specialist cleaner.. defo a job on the list, so applying as skilled PNP.

I'm already on this PNP application as his common-law..(my info was on his application, even when i was applying seperately)
but is there not a whole procedure for proving it all.. there must be more to it that writing my name on his form!!!

well, there will be the need for proving your relationship to cic for sure. but i don't see a checkbox on the bcpnp checklist that suggests that you need to provide that proof to bcpnp.
i'm sure that doing a search with something like "declaration of common-in-law" or the like turns up previous threads about similar questions. as i said, i don't have personal experience with this.

i don't know what a specialist cleaner does... so i can't verify that he would belong into one of the skilled categories of the noc matrix (0, a and b are considered skilled occupations).
please, please make sure your boyfriend is eligible to apply under the strategic stream to avoid more disappointment.

edit: i don't like to be the bearer of bad news but a quick check puts cleaners under 666 which is in category d... and a search on bcpnp has "6662 specialist cleaners (hotel only)" listed under the semi-skilled stream. the rules are way different from the ones for skilled workers - please read them carefully.
i don't know if your boyfriend fulfills the requirements to apply?
Employment requirements

Nominee applicants must have been employed in an eligible occupation by the sponsoring company on a temporary work permit for at least 9 months immediately prior to the date of application to the Provincial Nominee Program and must be legally employed by the sponsoring company at the time of application.
