i went to have my interview today, interviewer told me that i must remarry my wife again to get the visa !!, he said because your wife got married you before getting her divorce decision, you must remarry her again .
our marriage is done outside Canada and is done in country whcih allows to husband to get marry more than one wife according to law there.
my wife thaught that her divorce is done few months before meeting me because she did not receive her divorce certificate, her lawyer told her the divorce is done so she did not care about the certificate, her divorce certificate is sent to one of her friends by mistake, her friend called her and said i received your divorce certificae !!!.
the reason for the divorce from her first ex-husband was homosexuality, he was a gay, the matter took one year from the separation to get the divorce certitficate.!!!!!!!!!!!
that is why we applied as common law partner and we did not apply as spouses, my wife mentioned that in her application.
of course both of us we did not discover the fact regarding her divorce until we asked her parents in Canada to get a copy of her divorce certificate to send to us.
the interviewer insisting that i have to remarry my wife again to correct the situation although we did not apply as spouses!!! we applied as common law partner.
he said come to me at any time when you have the new marriage certificate!!! , i will give you the visa!!!. any time and he gave me his name.
is ther anybody believe that?
also the interviewer asked me to sign a printed form without giving me the time to read it and said that if you are NOT honest regarding the information your provided us you will in jail in Canada!!!, i told him i DO NOT mind to sign it and i did.
he gave me all letter i sent with my application, thes letters are from both of my parents in law and my wife which are sent to me, he also gave me all photos belongs to me and my wife together, he said that he do not need them and i should take them.
i give the interviewer three letters written by our canadian and american friends saying we are good couples and we have a real countinues relationship for more than two years BUT the interviwer refused to accept them!!!!!
Do you think all what happened was a trick from the interviewer to test me? or what?
did they really refuse me ? if yes why he asked me to sign that form? and why he said " You will be in jail in CANADA if you are not honest"? why mentioned CANADA if i am refused!!!!!!!

why he said i will give you the visa when you bring your new marriage certificate ?
ALSO during interview he said "WELCOME TO CANADA" but he kept asking me after that?

Please i need the help of all experts regarding this, and Please try to answer all of my questions because i am so depressed and so sad.

i appriciate it

where did u have ur interview?? I duno, to be honest, wat the officer meant!! but, did he say to u that u are refused this time?? if he did, then i am afraid, u will get a refusal letter soon....
wat did the officer say to u abt ur case this time?? i mean, yes, he told u abt the re-application thingy, but did he mean to say that this time ur case is refused??
things are not clear to get an answer
hope u will be more precise and then we will probably answer ur query

the most time of the interview was about how my canadian wife got married me although she did not get the divorce first, i explained to him she did not know that the divorce decision is done in OCtober, she thaught the divorce done in March. we got married in august.
so at first he said the case is refused but he spend more than 30 minutes after that asking me questions and at the end of interview he said i will get the visa when i bing the new marriage certificate .
he gave me sticker with my file no and he said this is your file no.
he told me you can bring it at any time, iam here and you can ask to see me again, he told me about his name.
i said what about if i failed to get it becuase we are legally married according to law in my country and according to law in the resident country and how i can ask to get marry my wife again if we are already married, he said then i will know that you tried to get it so go get it , it will take two minutes to get it!!!
so i left with very confused thaughts .

i think u should do as the visa officer said!! u will get the visa if he said he would grant u the visa! the reason why u have to re-marry ur wife is becuz the marriage certificate that u gave them was frm the time where u werent legally married becuz of the divorce issue!
so, do as the visa officer said and there would be reasons to smile

We appliedas common-law partner so WHY MUST WE REMARRY AGAIN!!??
WE DID NOT APPLY AS SPOUSES.
SECOND HOW CAN I GO TO REMARRY AGAIN IF MY WIFE STATUS IN THE COUNTRY WE ARE LIVING IS A WIFE OF MINE AND IT IS WRITTEN IN HER VISA " TO STAY WITH HER HUSBAND" , MY NAME IS MENTIONED IN HER PASSPORT AS HER HUSBAND.
IF I WENT EITHER TO MY EMBASSY OR THE COURT IN THE COUNTRY IAM LIVING IN, THEY WILL FIND THAT I AM HER HUSBAND BECUASE IT IS WRITTEN IN HER PASSORT.
THEY WILL ASK WHY I WANT TO REMARRY MY WIFE AGAIN IF IAM ALREADY MARRIED!!!, THEY WILL ASK FOR A PROV OR CERTIFIED DOCUMENTS SAYING OUR MARRIIAGE IS NOT VALID, THEY WILL ASK FOR MY WIFE 'S DIVORCE CERTIFICATE CERTIFIED FROM CANADIAN FOREIGN AFFAIR TO CONSIDER IT AS A PROV.
COULD I CERTIFY MY WIFE'S DIVORCE CERTIFICATE PHOTOCOPY FROM CANADIAN EMBASSY IN THE COUNTRY IAM RESIDENT IN??

They should have asked for that when you initially got married and then you wouldn't be in this mess now. Sorry but it was yours and your "wife's" responsibility to make sure that she was properly divorced before you made arrangements for a wedding date. I digress, why don't you just do as the Visa officer says and just get married again - if you don't, you probably will not be allowed to come to Canada as your wife is a bigamist and will be at risk from going to prison!

It is difficult for anyone to say without all the evidence and dates etc. in front of them. If you applied as common law couple at time of application, THEN married, your circumstances have actually changed since the original application was sent in. I think you should have told them of your "marriage" when it happened. This would I think change the status of the application.
If you had not married then it may have been easier as you would still be common law partners. I stilln think her lack of divorce cetificate may have been a problem.
If you did send in all these documents they have obviously seen that in the eyes of the law in most people countries including Canada, your wife was not divorced officially at the time. In any other country this is bigamy, and illegal.
Because of this fact she would have no rights under Canadian law as a wife, and it could appear as if your marriage was for convenience to get into Canada.

If you have official proof of her divorce, then you could get married again and it will be official.
I don't know where you live , but you do not have to get married in your own country even. As long as you have official proof of her divorce , birth certificates etc you could marry in another country. many people form Uk get married in USA, Cuba, Jamaica, Europe etc. You often have to be resident ( on holiday) in the country for a week or so to satisfy the countries rules, but many of the travel agents etc. arrange all these things now, and make sure you have all the relevant paperwork necessary.

If your countries laws are not recognized by Canada, or the rest of the world, you are not doing anything wrong in "remarrying" your wife.
Re-marry in Las Vegas !!, its a great excuse for a party!! and it appears you will get your visa.
