Default Any Quicker way for PR's of Canada to call their wife??PLEASE HELP!!

Respected Sir/Mam,

My name is Mudita Varshney, and i have just got married to Daksh
kumar, holding permanent resident card of Canada.I am in INDIA right
now. I was investigating on the procedures how my spouse can sponser
me, i was told that it may take anytime from 6-8-12 months!! How do
ppl manage?I mean what do other wife's do??Do they just sit back in
INDIA?and wait?
Also, My husband do not have a job rt now!! I am told,that it is
always better for him to apply for me when he has a job.

Since, i worked in US for more than one year,i need to get police
clearance from FBI,US and also from State(CA) where i stayed. IS this
true!! That takes another 2 months!!
Please suggest, I desperately need help, as to how can I join my
husband in Canada sooner!!
I have done masters in CS with 4 years of Exp and working in INDIA as
Senior Design telecom engineer ,So I was trying for a job also in
Canada from india, but it looks kinda tough.Once needs to be back in
canada to get a job if there is any....What DO I DO??Please HELP and

I don't know much about Canadian immigration law. You might want to try
the misc.immigration.canada Newsgroup instead.

This may or may not be true. You may be able to get this from a US
consulate.

Can you try and find a job of your own, and get your own visa to Canada
independent of his?

Well, one thing you can try is study in Canada. I don't know if this will
work (it would be problematic in the USA).

Hi Mudita,

Unfortunately, there is nothing you can do to speed this up. Canadian
immigration processing doesn't move any faster due to the number of
applications they receive and the time it takes to conduct the background
checks. It is definitely better, if your husband has a job before he
applies because he has to prove that he can support you, so I'd tell him
to find something as soon as possible in order that you can get the
paperwork moving. Keep in mind that if he has a lot of assets, it
doesn't matter if he doesn't have a job.

You do need to get police clearance from the USA too.

Please answer few more queries,since i have a little more insight on this now ::

1) I agree i need Police clearance from US, but can that be issued
from US EMbassy in India or it has to be coordinated with FBI,US.
2) Do I need Police Clearance from CA,State also where I lived??
or only FBI is sufficient for Canadian immigration purposes??
3) Can i easily come on Visitors visa, if my husband has applied
for my immigration?Since it takes so many months, can i just
take visitors visa for 6 months and stay with my husband??
Do ppl do this?
4) Some suggested me to find a job in Canada!!How long does it take
to get work permit, in case i get a job!!
5) You mentioned that application should be well -prepared....Is
there any special preparation to be done?? Do, you think,one
should always go via the consultants to be on the safer side??
Can they make things faster and proper than we doing ourselves.

Please keep in mind that I'm not an attorney, but this is what I've learned from a lot
of reading and talking to my lawyers.

1. You can check with the US embassy and see if they'll do that for you, but I highly
doubt it; we had to request our FBI clearance stateside. You have to get your
fingerprints done and send them to them with the cover letter suggested in the CIC
documents.

2. You do need police clearance from California too.

3. You can ask for a visitor's visa, but it's up to the consulate whether they'll
give you one while your status is pending. Some people are able to get them, others
are denied. Now if you do get a visitor's visa and overstay, you could - people do
this all the time, but you're lying about your intent to stay and that could cause you
some problems later. A lawyer or legitimate immigration consultant could better
advise you there. Keep in mind that even if you do get a visitor's visa, there's
still no guarantee you'll be allowed in. I've seen the immigration officials detain
people at the Canadian airports with valid visas because they think they'll stay. So
be aware that you could fly in, but be refused entry at the airport.

4. If you have your permanent resident status, you can apply for a social insurance
number and you don't need a work permit. You can get the SIN number pretty quickly.
You only need a work permit if you come to Canada with a visa and you won't get one as
a visitor. Without your permanent resident status, a company would have to sponsor
you and that would take a few months; as a result, a lot of companies won't hire you
unless you have exceptional qualifications (ie they don't want the headache and cost
of the CIC paperwork)

5. There is no reason why you can't complete the documents yourself; you seem to
have a good command of the English language. Just make sure your application is
totally complete, or it will hold things up. Lawyers and consultants cannot make the
process faster, they just make sure the paperwork is completed and filed properly.
I'm not sure which city you're planning on immigrating to, but I use a well-known law
firm in Vancouver (www.cwilson.com). Lawyers in Canada aren't cheap, but if it's a
good firm, you don't have to worry that they'll take your money and not prepare or
file anything. (If that were to happen, there's an insurance fund through the bar
association to protect you.) Consultants are cheaper and some have as much knowledge
as the lawyers, but they don't necessarily have insurance and they aren't currently
regulated. I went with the law firm because it's well-respected in the community.

6. This isn't an easier path. You don't want to study in Canada until you have your
permanent resident status. The universities charge foreign students 2-3x the rates to
attend and it takes awhile to get all the paperwork in order. First you have to apply
to the University you want to attend, take an English proficiency test, and if they
accept you, apply for a student visa (you can't work). Because it's already mid-May,
you're too late to go this route for the Fall term. Most people apply in January for
the Fall term.

7. Your spouse must be living in Canada to sponsor you, but he is allowed to make
periodic visits out the country.

One more thing: if you were able to find an employer to sponsor you, the process
takes a few months - could be longer if you need HRDC approval or not. It depends on
what category the employer brings you in under.

Hello Mudita,

I can understand your situation to be away from your husband, as we too (my wife and me) had been through this kind of experience. Let me tell you my experience. I came here in Sep 2001 (from KGF, I was working for a central govt research organization there) as a student with full funding from the university to do MSc in Mining Engineering. I thought I can bring my wife and kid (at that time just one and half years) after 3 months or so. But unfortunately, they denied visas to come as my dependents, even though I demonstrated the necessary funds.

Then I kept quiet for about six months. Later I tried for her admission in some master's course (She has already Master's and a BEd degrre in India) in the same university. Luckily, I could talk personally to a Prof about my situation and managed to get her admission for Graduate studies in Humanities. This time she applied for student visa and got it. She came here in Aug 2002 and is still with me. But she has to return to India by the end of Aug as her visa will be expired by then. Anyway, now our immigration is in process (at Buffalo) and we hope to get it by the end of this year.

As some one told you already, unfortunately there is no faster system to get spouses and other dependents here. My suggestion to you is: if you don't want to wait that long, then it will be better to come as a student here. Pl ask your husband to explore the possibilities in this direction.

Otherway is: If he has enough money (he has to show atleast $15000), then you can try to come here on visitor visa. I don't know whether your PR application can be processed from within Canada, while you are on visitor visa here.

Pl ask your husband to get some kind of job. I hope that will definitely help you to unite at the earliest.

Hello karen,

First of all , Thanks a Ton for given solutions to my queries.

IS getting Vistors visa impossible after immigration has been
filed.!!wife has to stay in INDIA for MIN 6 months?IS that true??

Secondly, since i worked in US for 1.5 yrs , i will need FBI clerance,
I found out on CIC site , that i will need CA(State) Police clearance
certifucate too....Do you know the procedure to get that!!

When should i get my medical done, Just before after we file??

Please answer!!

Are you talking about immigration to the US or to Canada? If you are
talking about immigration to Canada, then posting to
misc.immigration.canada might give you better information.

I don't know anything about Canada, but if you are talking about
immigration to the US, here is my response:

In practical terms, it is usually very difficult to get a visitor's visa
after immigration papers have been filed. However, there is no harm in
trying. If the visitor's visa is denied, it would be for suspicion of
immigration intent. Obviously, that is not an obstacle to getting an
immigrant visa.

As for getting the police clearance: the best point of contact for you is
probably the US consulate in India.

As for the medical, since you are applying for consular processing, the
consulate will tell you how to do it. It is usually a few days before the
interview.
