I am Indian Citizen and working in US, I applied for PR Canada in Independent cat to Buffalo,NY. few days back My wife cleared the interview in Canada Consulate in US as she is principal applicant. We both are in IT field on H1-B visa in USA.
We both sent FBI card finger printed by Police department of US to FBI, I got my Finger printing cleared but my Spouse was asked by FBI to send the Fingerprints again, the reason was given by FBI was: "The quality of the characteristics is too low to be used".
My wife again did the finger prints by Police department and they told that Now it will be OK from FBI, but Saturday I recieved a letter from FBI which states:
IT IS OUR UNDERSTANDING THAT CANADAIN AUTHORITIES MAY allow alternative measures in cases where legible fingerprint immpressions are difficult to obtain. We suggest you cantact the office handling your case residency for clarifications.
We will be sending the letter to Canada consulate in US for this problem.
We both decided to go for medical next week, but now we are worried that if FBI has problem then what to do?
We planned to go for Medicals next week and have fixed an appionment with DMP.
1. Should we proceede with medicals or wait till we get some reply from Canada Consulate regarding this Finger printing problem?
2 we both stayed in US for 2 years and at the time of interview the immigrant officer asked us if we have any convition in any country and we replied honestly NO and we also signed before immigrant officer.
3 I read in some news grup that some one had the same FBI fingerprinting problem but do not know what happended to him/her.
I am worried about this issue and don't know what will be the reply from the Candian consulate ?
Dear Experts, what could be the probable reply from the Canada consulate. On my spouse fingerprint card FBI put the stamp of "Unclassified". Does Canada Consulate accept this as " No criminal Record" ? What are possible alternate things or proceeses i may have to go thro in absence of the FBi fingerprint clearance ? Does the Immigrant officer and the canada security agencies has the authority to waive the FBI clearnce ?

I am really confued and don't know what will happen.
Any help will be highly appreciated !!!

Manish,

Go ahead with your medicals and immediately contact Buffalo and ask what to do
providing them with the letter received from FBI. You will be instructed how
to proceed.

Dear Andrew,
Thanks for the information.I just Spoke to Buffalo office and they advised me to send the FBI letter to NYC Canada Conulate as my file is with them. I have Mailed the letter.
Just I am worried what will happen in this case and dont know what kind of instructions I will recieve. Can you give some hint what could they instruct?

Manish,

I know as much as person in Buffalo - if they would know what decision Consulate in
NY will make and what you will be instructed to do they would have told you already.
But don't worry too much, it will not be anything you cannot simply follow. I
personally don't know any case with similar to yours problem with fingerprints, so
any hints from me would be just guessing on my part...

Don't worry, if necessary, they will probably have your wife referred to a
specialist to have the fingerprints taken. On really rare occassions where a
person's prints are unable to be read (lack of oils/whorls) the person is usually
refered to a person who has experience in fingerprinting the deceased, they are
usually able to get a usable print.

Thank you Andrew and PMM for the concern and reply. I am just waiting for the reply from Visa officer, as sugessed by PMM can the Canada conulate refer my wife to fingerprinting expert in US ? or it is our duty to find out that kind of expert? I think if they do that then she has no problem but If finger printing taken by the expert are again rejected by FBI?
I know that now USA, INS has started taking Finger Printing for US Green Card through Computers and no INK, but it is Canada immigration matter so the INS in USA will not do it for my wife!!!, just waiting for the reply or the conulate Visa officer might have to consult with Canadian security agencies, I think when they get reply from Canadian security agencies, then only they will let me know what to do.

Manish,

Only Gods know what is going on, but one could assume that you are close to the end
of the process, although strange things may happen as you haven't got any reply about
your wife's fingerprints yet. Fax the proof of ROLF to the Consulate and call them as
well just to assure that everything is taken care of.
