What is "kivett" in real estate?

Default What is "kivett" in real estate?

Hi all,

A word that keeps popping up in real estate adds is "kivett" which seems to translate to Removed / Taken-Out and it is often before House or Road, so trying to work out what it means. I'm guessing it could mean private road, but not sure what a kivett house is ?

From the govt website

"A más célú hasznosítás megszüntetése után, illetve a más célú hasznosítás 4 évet meghaladó szüneteltetése esetén az igénybevevő, illetve az igénybevevő személyének eredménytelen megállapítása esetén a terület tulajdonosa köteles a területet, de legalább a terület felét mező- vagy erdőgazdasági művelésre alkalmassá tenni, és annak hasznosításáról gondoskodni (újrahasznosítás). Művelés alól kivett terület újrahasznosítására készített tervet - a bányaterületekre vonatkozó tervek, valamint az erdőtelepítés engedélyezésére vonatkozó erdészeti hatósági eljárás kivételével - az ingatlanügyi hatóság hagyja jóvá. Az erről szóló határozatában az ingatlanügyi hatóság megállapítja az újrahasznosítás célját, határidejét és előírja az újrahasznosítás érdekében az igénybevevő kötelezettségeit."

And translated

"After the cessation of utilization for other purposes or in case of suspension of utilization for other purposes for more than 4 years, the owner of the area or the person of the user is obliged to make the area, but at least half of the area suitable for agricultural or forestry cultivation, and to take care of (recycling). The plan for the re-use of the set-aside land, with the exception of the plans for the mining areas and the forestry authority's permit procedure for afforestation, shall be approved by the real estate authority. In its decision on this, the real estate authority shall determine the purpose and deadline of the recycling and shall impose the obligations of the user for the purpose of the recycling."

The simple explanation is that a plot that is described as kivett terület is not agricultural land and so does not come under the agricultural regs. and restrictions.

I'd still love to know how kivett / removed / taken out should translate so that it makes more sense if anyone knows please

Example :-


- Hrsz 0104/5: kivett, saját használatú út.
- Hrsz 0104/6: kivett lakóház és udvar, legelő, kivett saját használatú út, kivett vízmosás.
- Hrsz. 0104/8: legelő, kivett saját használatú út, legelő és gazdasági épület.

= plot number 0104/6: removed (from agricultural use) dwelling and courtyard, pasture, removed (from agricultural use) private use road, removed (from agricultural use) water washout.
In this example the dwelling and courtyard and the water washout are not agricultural land whereas the pasture (legelő) is agricultural land.

Hrsz. 0104/8: legelő, kivett saját használatú út, legelő és gazdasági épület.
= plot number 0104/8: pasture, removed (from agricultural use) private use road, pasture and farm building
In this example the pasture and the pasture and farm building are agricultural land, the road is not agricultural land

The term 'kivett' comes immediately before the defined area and only that area. If 'kivett' is not present then the area is agricultural land. The ownership of agricultural land is regulated and unless you qualify to own agricultural land you are limited to 1ha ownership. The purchase of agricultural land is also regulated and best subject of a new thread if you need to know.

Note: the term gazdasági épület is a generic term used for lots of building types. The literal translation would be economic building, in this example I would expect the building to be a farm building (barn?) but it could equally be a storehouse, a workshop or even a factory.

FYI I have finally found out that the correct translation of Kivett is "Taken out" and it is short for "Taken out of cultivation"
