I checked with our accountant before we sold and we have no CGT to pay. Our allowances cover it. He assured me that we could also claim the cost of trips out to sell and associated expenses. All our money is in the bank.

Nice to hear of another person successfully selling their property.
How about making another couple of posts on either this thread or some of the other threads? That way you will be able to pm other folk on here.
The reason the topic of repatriating your money needs to be kept away from open site is because there are people from Indian authorities who read this site - need I say more?!!
I would not advise buying gold as suggested on here earlier.

Agreed, I would advise not to discuss repatriation of money or means of sale on the open forum, and I would only discuss by pm exclusively with people I have met or have been recommended as secure by trusted members.

I totally appreciate the need for discretion!
I can forward copies of emails between my buyer/Advocate if necessary as proof that I am genuine.
I have now had a quote from the Advocate on how much they will charge to prepare the documentation, I am thinking it is rather excessive. If anyone could recommend someone else that might be able to help, that would also be really appreciated.

Would you tell us how much the Advocate is quoting and wether you sold on a registered deed or on a sale agreement?

I have an agreement for sale.
The Advocate is quoting 15,000 for preparing the transfer doc and 25,000 for preparing the sale deed. I have written back to him saying that the fees are excessive and asking for another quote, otherwise I will go elsewhere. The developer is charging me 250 per sq fee for the resale.
The developer is charging the buyer 6,000 for legal fees, although he will also have to pay 2% stamp duty and 2% registration. I have advised the buyer of these charges and he says that he can recommend his Advocate who would charge less, but he is happy to pay the fees if I decide to continue with the same representation.

To me the fees quoted by your lawyer seem extortionate - all they are doing is effectively typing up a few A4 pages, most of which are proformas requiring them to merely fill in the blank spaces.
The fact that you are being charged 40,000 rupees by your lawyer, yet your buyer only gets charged 6000 rupees tends to speak for itself. That's one hefty percentag of 'skin tax' !
There are several lawyers in Goa who regularly deal with foreigners and absolutely fleece them when it comes to fees.
Also shouldn't the buyer be paying for the sale deed?
As for your developer - yet another example of criminal extortion where you are being charged to sell what you have already paid full price for. Unfortunately this seems to be an accepted practice over in Goa, but it could be worse as some folks are being blackmailed for up to 20 lakh to sell on agreements of sale.
Would you be willing to pm me the name of your lawyer? I ask this because I have collated a lot of information and do have an idea of which lawyers should be avoided, and if your lawyer is one of the 'usual suspect' I can inform you. I guarentee confidentiality for any information you provide (please feel free to check this out via the moderators).
