What difference does it make if the builder does or does not own the land. We live in a Regal property, and I always thought that they owned the land. Hi More, From my knowledge of Regal builders they are highly reputable and they have clear title on their properties (land). Regal Builders offered people their money back last season. I am talking about builders who have built on land, borrowed from the bank!!!!! sold all their properties, and people are now finding that the builder did not own the land their properties are built on.and the bank has called in the builders loan. There are enough pitfalls for us all without these cretans. :curse: |

None of us have heard any more since last January (touch wood) our Advocate says no news is good news. I have a friend who has been called to meet DE second week January in Panjim - will let you know the outcome when I hear. Happy New Year |

Just signed up to this site as I want to thank you all for relating your experiences. Fascinating thread, was up till 3am reading it all last night. We came back from holidaying in Goa just before Christmas, as we have done for the last few years now. We have always booked package deals but were seriously considering buying a place, primarily for holidaying until we can affords to semi retire in about ten years time if everything goes to plan, then spend six months of the year in Goa in our own apartment. Glad I read this thread as you have convinced me that it is a very bad idea. There seems to be a lot of misinformation around regarding FN's buying in India, and as many of you have pointed out some people will happily believe what they want to hear. I find it hard to understand how people can 'invest' relatively large sums of money without doing a bit of homework beforehand. A work colleague of mine was only telling me in November that the rules regarding ownership have been relaxed and you don't even need to do the 183 days any more! We will still holiday in Goa as we still love the place, despite reading the various threads on this site. We intend to fly through Mumbai and rent a private apartment in Arpora, as this gives us better flexibility than the package deal. We can stay for about 3 weeks and plan to fly home between Christmas and new year. BTW, have there been issues getting 180 day tourist visas this year? We were planning to go to visa clinic in a local mosque but I was working in the US so we sent for a visa in October via one of the recommended agencies. A bit more expensive than getting direct fom HCI (which I know you can't do anymore via the post) but didn't have any problems or delays - our passports were returned within a week. Seem to think I have read that others have had problems. Hopefully won't be any issues getting tourist visa for next year. |

Hi Dave, Happy New Year and Welcome to the Forum,:thumbsup: Glad to here that you have been doing your own homework regarding Foreign National Property purchase in Goa. It is definately not a good idea at this time and i'm sure your aware that it is illegal for a non resident FN to purchase immoveable property anywhere in India period. The best you can hope for at this stage is a 5 year renewable lease scenario which in itself has problems ......mainly your being charged Freehold Price for a property that you will never own under the current policy, legislation and dare i say mindset.:( The paragraph in your post which i highlighted in bold is a fine example of the rumours and mis-information that exists out there in the public domain and is the reason why so many of us on here are trying to raise awareness to unsuspecting potential investers like yourself. Doing a little bit of research has un-doubtedly saved you a lot of grief as well as money and its good to see people like yourself taking notice of the warnings on sites like British Expats. Regarding your visa query....yes it was an absolute nightmare in November and December but the HCI London (realising their mistake) has started accepting postal applications again...so i believe that all is well....for another while anyway. I am very new to this site and probably need to be brought down to earth with a very large bump by yourselves. I am British and my wife is Indian (still with an Indian passport and not dual nationality). After 21 happy years in the UK it is time for us to buy in Goa and live there in our retirement. Do you foresee any complications even if we buy totally in her name as she is an Indian National but not a resident? Will I have any problems living there as a permanent resident with my wife? There are many things we probably haven't even thought of so any advice you can offer would be greatly appreciated. Thank you, Clive |

You could apply for PIO status as you are a spouse of someone who is Indian. You will find the relevant forms and details of the application process on www.hcilondon.net. Then you could have the property in joint names. I am not sure about residency but there was a similar question asked on www.indiamike.com the other day but I cannot remember the answer. Your plans for buying in GOA and then living there for 6 months of the year in semi retirement was exactly what I was planning to do. I did quite a bit of research and then put a hefty deposit down with Churchills on a new development at D'Costa Palms, Siolim. It was then that I discovered this forum and realised that the homework I had done only scimmed the surface and only answered the easy questions and not the nasty ones the developers shy away from. Initially I put my head in the sand assuming all would be well and life would be rosy. Sadly that is not how things have panned out and now after much letter writing I have managed to get all my money back from Churchills who are still adamant that my sales agreement was legal and as sound as a freehold - I DON'T THINK SO!!!:curse: So it won't be long warm evenings in GOA for my retirement so back on with the thinking head for plan B. Incidentally I would be interested in what deals you are getting for long term rent rather than package deals. Sorry I couldn't be more positive but please believe what Noni, Remmy, Douglas (if he comes back to the site) and the others tell you about non Indians "buying" in Goa because they really have done their homework. I think that you purchasers should hang on a bit. The laws on foreign investment in India are changing very rapidly for business and afterwords for personal investment. Having been about a bit I feel that it is just unwise to buy anyway and anywhere other than in country of nationality - but hey etc.
I think that this sort of hassle will change if for no oither reason than it being assymetric - ie and Indian National (with or without residency) can own a property in UK. Against that is the resistance to foreigners pushing the prices up. Nice place but probably better in the 60's! Happy new year. |
