UK visit visa plus UK family visa for spouse

Default UK visit visa plus UK family visa for spouse

I and my wife are both currently residing in India holding Indian passports, with my passport having a UK Certificate of Entitlement to Right of Abode stamping.

I wanted to know if the following is permissible:
1. While we both are in India, is it possible to obtain a UK visit visa for 6 months for my wife? Otherwise would it make sense to apply for example for a tourist visa for my wife.
2. Once her UK visit/tourist visa is stamped and we get her passport back can we immediately submit an application for UK spouse visa? There is an option being provided by VFS here of retaining her passport with us till they ask for it for visa stamping (a paid premium service).
3. Travel to UK together. I based on my right of abode and wife based on her UK visit/tourist visa already stamped on her passport.
4. Once we receive a communication that her UK spouse visa is approved, she can travel back to India get her UK spouse visa stamping done and then travel back to the UK on her UK spouse visa.

Is this possible and legally permissible? I could not find any information about this on any official UK government website. Your help will be very much appreciated.

Even if that was physically possible I wouldn’t recommend it. Being in the UK when an application for Leave to Enter the UK was granted would create unnecessary problems.

I thought the spouse visa HAD to be applied for from outside the UK.

Not necessarily, you cannot switch from a visitor visa from within the UK, but you can switch from say, a Tier 4 student visa or Tier 5 Youth Mobility visa.

The OP is talking about the possibility of his wife applying for a spouse visa from India, reclaiming her passport and then travelling to the UK to wait until it is granted before returning to India to have her vignette inserted into her passport before returning to the UK.

ISTR that one forum member DavelovesDee? tried to do that and his wife was turned back by immigration
