We are moving back to the UK in Sept 17, I am British my husband a US citizen. Looking at UK.gov - very confused regarding "settlement" We satisfy the income/capital requirements, have a UK bank acct, and own a house in UK. The visa info refers to "joining a spouse settled in UK" Does this mean I have to return home before he can apply for visa? and then come later, Or can he apply and we both return together? Its all very "vague" Any advice would be great Thankyou

You can do either. What your husband can't do is come to the UK and you remain overseas.

If you meet the financial requirements now then you can apply now and travel to the UK together.

The term "joining a spouse settled in UK " is badly termed. You as the Brit spouse are considered settled as soon as you enter the UK, so your husband is termed as joining you.

You can go first if you want. He cannot enter the UK without you.

The OP's husband may want to open an UK bank account in the US before moving to the UK. HSBC offers this service, please see link below -

Make the on line application, with everything in order 'I's' & T's' dotted, all the requried supporting documents, he should have the visa within 8 weeks after application
