Default Englishman married to Brazilian ,settlement visa

Hi I want to get back to England next year as I have realised that Brazil will not hold a bright future for my wife and I!!! I dont know how I am going to show enough money and that I have accomodation, I am earning peanuts here in Brazil and so is my wife. Can we stay with my parents is that an option? I have a job in England that I can go back to,it doesnt pay well but its a job! I get very down thinking about the whole visa process,I do not want to leave my wife alone here in Brazil whilst I arrange everything in England. I spent 4 months away from her last year due to immigration turning her away at heathrow, she wanted to visit my family but was refused entry( I had stayed illegally in Brazil a year and a half) as they thought she would not go back. I got back to Brazil with a student visa and we are now married, its been nearly a year since the wedding, ive tried here in Brazil but its not for me! My wife is currently learning english (very slowly!!!)for the english speaking test. I dont want to be away from her again is it possible to arrange everything here in Brazil? I dont want to risk her being denied a settlement visa.

So you need to get a spouse visa for your wife; start here:

http://www.ukba.homeoffice.gov.uk/vi...led/spouse-cp/

You need to have income/assets of at least 18,600 per annum to support wife without recourse to public funds. See here for new rules:

http://www.ukba.homeoffice.gov.uk/si...mily-migration

Yes,you can apply from outside the UK. If your parents can provide accommodation then that would help.

If neither you nor she has any income or assets then you are going to have a tough time of it moving to the UK.

If you are open to movement, why not spend say 6 months in Europe working with your wife and then move to the UK under the EEA rules.
Free visa no money needs to be shown and easy route if you can work in Europe for a short while

why dont you get into contact with immigration lawyers in the UK who can help you, you will have to pay them but in life usually when you pay you get more/better services.

It is always best to deal with people who are experts in a subject, how many times has the OP been in this situation, zero so he does not know how best to go about it.

Our experience with immigration lawyers was terrible. We went with a tier 1 specialist who was meant to be the best immigration lawyer in London and got advice which was simply not in accordance with the rules from someone who hadn't even read our file. I can let you know who to avoid if you do decide to go that route.

You could look at the advice given by those who have done and been successful and look at immigration sites, the OP has a pretty straight forward issue
