Default Permanent Resident App from in Canada

I am about to submit my application, as a common law partner of a Canadian citizen. We are both in the throes of divorcing our ex partners, and have been apart from them and living together for over a year. The form asks if she is 'legally separated'. Though the divorce is nearly finalised, and uncontested, she has no legal document to prove this. We have loads of evidence of our relationship, so do we still need to send this proof?
Any advice appreciated. I am OK for everthing else, eg medical, funds etc. I just want to get it right.
