my boyfriend and I moved here in December on a TWP and although we love it here Im at the end of my tether as to what to do. When we arrived my boyfriend couldnt work for a month due to the weather as he is a bricklayer. He eventually started mid Jan after we went through a lot of the money we brought with us and we thought all was going well. So the beginning of this month imagine my shock when his d!$k of a boss sacked him for absolutely no reason! The recession has nothing to do with it as the guy is taking on new staff! The boss kept pestering my boyfriend to speak to the bosses lawyer about some domestic dispute that he is having with his wife and my boyfriend quite rightly refused as he is an employee and its none of his business. So the next day he gets the sack. No notice no nothing and is now refusing to pay my boyfriends over time but thats another story.

So all in all I just do not know what to do Im so worried!

Get in touch with Employment Standards Branch http://www.labour.gov.bc.ca/esb/

I believe you will find that if he has been an employee for under 3 months no notice is required, this is still considered probationary period. He is still entitled to pay owing, he can file a claim through employment standards.

Speak to employment standards, they will tell you what is what.

we have already done this. they give you a self help pack and encourage you to write to your employer but this didnt work so we are in the middle of filing a complaint. Im more worried about the getting another job part

Your okay to stay until your TWP expires. So hit the ground running and get round to as many other construction companies as possible to find him a new job.

If you haven't already, get yourself an Open Work Permit so at least you can work and bring some cash in whilst your OH looks for a new job.

This is not England. As long as they provide you with the appropriate notice, they can pretty much fire you at will.

As others have said, you need to obtain an spousal open work permit and your OH needs to find another employer that is prepared to employee him asap.
