Well today I got some legal housing advice and of course they said that the landlord is talking bollocks.
He also said that we could get the deposit back in a small claims court but then of course we would be obligated to clean the flat from top to bottom including the carpets.
He then said that of course as we are convinced we wont get our deposit back (we know we wont), then we can walk out of that flat on the day we leave and not bother cleaning it.
Of course we will be leaving our tattiest furniture in the flat which is too far gone to repair (or at least it will be) and a tatty old fridge on the porch.
And you know what? I dont give a toss because walking away is going to be far easier, nothing to clean or tidy. Far easier than going to a small claims court and fighting our case from Perth.
Any time now, the Estate Agent is going to knock on that door and of course I am going to be uber polite, carry on sipping my tea and surfing BE while Mr PP deals with it.
Bring it on.

Load of old bollocks.
The estate agent has gone and is going to check it all out. Mr PP and him were talking about the football tonight and Mr PP ushered him out of the door because both of them (Mr PP and the agent) are keen to watch the match.

Me, well I am going to chill and relax on BE.

He said it was a private agreement between us and him to say we would give him two months notice.

Hope Mr PP can get matey with him about football and the EA will smooth it all out with him.As others have said, why not just leave. If you are going to lose your bond whatever, just nod and agree and pay 1 months rent. When he comes to collect the second, you'll be gone.....

well even if you did make a verbal agreement (which u didnt) it means nowt so he hasnt got a leg to stand on!! Hes just trying it on. EA should know this anyway as surely they would have formalized any agreements between yourselves and landlord. Its also illegal to withold your deposit but a s others have said is it worth fighting to get it back, just cancel your standing order and stick 2 fingers up at him

Crappy landlords are the worst. We've had one amazing one, a couple of fair ones, and some utterly terrible ones. One landlord made my then flat mate cry, he was so mean to her! Utter buggers. Good luck with it all, and call the police if he starts hasselling you. He could have had new tennants every 6 months for the last 10 years and all the cost that entails if he was unlucky. There should be a bad landlord / letting agent website, so people can leave reviews - a bit of a motivation for landlord not to act like money grabbing arses, and instead consider the people who pay them every month, whether they like it or not.
Grrr.
