Well as many of you may know we found it hard to sell our house, we have had a 457 visa for over a year but could not move over as we could not afford to pay a mortgage from the other side of the world.
Well yesterday we accepted an offer on the house, it was not the amount we wanted to take for it but in this maket we took what we could get.
Emailed the company the OH was going to be working for to tell them the good news, this morning got an email back saying they have now employed someone else WTF and cannot afford to give him a job with the economy in this state.
Totally gutted, anybody got any advice what we can do not apart from cry

Bummer, but in hindsight, it may have been safer (jobwise) to rent in Australia until you sold your house in the UK.
By the way you worded this post, you have known that the job was available for sometime, but unfortunately nowadays companies cannot keep vacancies open indefinitely while waiting for your circumstances to change.

We would of always rented in oz anyway until we had PR and made sure it was the right place for our family.
We have kept in contact with the company every month to keep them updated and they have always said that his job would be there for him when we could get over.

It is very unfortunate that your house sale took so long & it is a great shame that the company were not more upfront with you about the possibility of employing someone else. Can you apply to other companies or is the economic downturn here likely to have affected the chances of another sponsor?
Any chance of going down the pr route?
Perhaps a chat with an immigration agent may be helpful?

As you had kept in touch with the company every month it's inconsiderate of them not to have kept you in the loop. Fair enough, if they could not hold the job open any longer but they could have told you and given you the option or at least your OH, the chnace to get to Oz and take up the job.:curse:

All i can say is keep persevering.

All my sympathies mate (although being a Man United fan the picture you use does limit that a little, and before you ask, no I'm not worried). Its a pity they didnt have the decency to let you know sooner.
A similar thing happened to me, only that I got out to Australia and had just started the job before they had cutbacks and made me redundant. So I'd virtually given my house away in the UK and moved over at my own expense for little more than six weeks work. In my experience, in terms of 457ers its very much easy-come easy -go, and I certainly feel as though I've been treated as a glorified fruit picker.
I've now extended my stay using a tourist visa and am looking round for a few things but firms seem very reluctant to take anybody on who hasn't got PR, which I assume is as a result of the fact that the increase in unemployment here means they can be a little more choosey in who they employ. You dont say what your line of work is, but you may come across the same problem.
On this basis I'm wondering if your best bet might be to put your money in a notice savings account (and get a higher rate of interest), rent a house in the UK and apply for PR. Then you could come over when the economic picture improves and the interest paid on your account would write off some of the losses you've made on your house sale.

I also think it shows poor courtesy if the company didn't warn you that if you hadn't turned up by x date then they would employ someone else.

Thanks everyone for the advice, we had a chat last night and decided to wait until the economy improves then we will go over. We are also going to look into applying for a PR visa Oh is still on the modl list so we should be ok.

Unfortunately there is only one side of the story posted on this forum, so I wouldn't be to quick to tear strips of the company.
Personally, if I was going to employ someone, I wouldn't wait months for them to start their job, if there was someone else to fill the position.
As an employee, I wouldn't expect them to wait more that the normal termination notice period, or agreed period.

Why didn't you then?
You would of at least had a home to go to in the UK if things didn't workout.

Um, I think you didn't actually read my post, despite replying to it and quoting it! I said *if* the company hadn't warned them that they needed to be in post by x date or they'd employ someone else then it showed poor courtesy. Courtesy is all part of good business sense. I didn't tear strips off them or anything like that- in fact I choose my words carefully to be supportive to the OP without making assumptions about the situation.

Here's what I actually said:

The only advice I can give you is to apply for your PR now, treat it as a matter of urgency with regards to your application while your skills are still on the modl list.

DIAC and the migration laws change all the time, I advised my mate to apply for her PR when she was thinking about doing it, in the time its taken for her application to go in, the goal posts have already shifted - according to her agent.

Dont wait for the house sale or take it for granted you might be able to apply in 6 months or a year or so, get your skills assessment done and your application in ASAP and then validate.

Then at least when your house does sell, you wont have to worry about the visa.
