i ask if you are a holder of a permanent residents visa you are here in australia but you have no intention to work or study here in australia. are you a resident. you are living off your savings in the uk. you recieve hardly any interset in the uk but you are drawing down on the capital held in the uk. are you on holiday here in austrlia or a resident.

Who is an Australian resident? The answer to this question is not as simple as it seems. It involves a complex area of the law. However, generally speaking, anybody who comes to Australia solely to work, even for a short time, will be regarded as a resident. Also, anybody who comes to Australia to study will be regarded as a resident. However, anybody who comes to Australia on a holiday will not be regarded as a resident.

It is complicated. One can be on a temporary visa (first part of the spouse visa) but permanent resident for tax purposes.

Indeed, you don't want to be classed as temporary for tax purposes or you will be hit with the withholding tax.

How many days a year do you spend in Australia?

Australia taxes you on your world wide income. However if you spend most of the year in Oz, you shouldn't have to pay any tax in the U.K.

Only if you haven't paid tax on it at source. Every time I've worked overseas I've been taxed in the country I worked in (Philippines, Myanmar, Bangladesh) and not paid Aus tax on the income even though it went straight into an Aus bank account. I would have been taxed on the money earned in Saudi as there is no local income tax but the project was Austrade approved which made it tax exempt.

been reading up am trying to understand what i will be classed as if i get my permanent residency. i am on holkiday here, and even after my holiday iw ill stay on holiday here even if i get permanent residency as i only intend to stay maybe six months. then i am returning to spain for a couple of years. its the six months i am here on holiday post touch wood getting my residency visa. am a taxable on my savings interest in the uk in the time as a resident even thoiugh i am on holiday or do i submit a lodgemnet or not when i leave. all savings are taxed at 20% in the uk. my brother in law is a ozzy but was a pom first. he has avings in the uk, never ever dosclosed it to the ato, they have never found out. his mate same thing but moved a chunk over to buy a house, the ato asked you have been here six years, never disclosed the capital, why not, so got found out.

so you can have a residentcy visa, be onholiday here in oz but do you then submit a non lodgement form or submit nothing in july 13? six month holiday no earnings/no income in oz but savings interests in the uk

did you investigate tax treaty rules? if you are aussie resident you may get a lower tax rate on uk savings interest. i'm not sure but maybe worth a look. but why not deposit in AUD instead? your interest income is potentially higher. dont count on the exhange rate reverting to old days though. the AUD is sttubornly strong despite rate cuts, mainly because central banks are buying more AUD than ever.
