Default speeding fine/ban

so about a month ago i posted (well think i did..lol) about my idiot partner gettinga $621 fine, the policeman at the time mentioned a 1 month ban...i looked it up on the rta for NSW and it says for that fine amount it would of been a 3 month ban!

Its been a month now and nothing has come in the post (i have the only key to the postbox we have (in apartment block) and so he couldnt have try to hide if from me...1) hes just not that clever, and 2) he wouldnt dare!!..lol

The fine mentioned nothing about a ban(i was the one went and paid it, so know that)

So how soon would he have heard?, he is obvisoulsy still driving his work van!

As at 1st July 2008

More than 30 km/h but not more than 45 km/h = 4 points and a $621 fine

You may have your licence immediately suspended and confiscated at the roadside for 6 months.

If convicted at a court for: More than 30 km/h but not more than 45 km/h, there is a 3 month Licence Disqualification.


As at 1st July 2009
More than 30 km/h but not more than 45 km/h = 4 points and a $647 fine and a minimum 3 month suspension.
But sometime between March 2009 and now, it became:
More than 30 km/h but not more than 45 km/h = 4 points and a $621 fine and a minimum 3 month suspension.
I am not sure but it may have been 12th June 2009.

You may be in the first category, with no suspension.

It may state "may" but I guarantee you that at that speed it will be a "will".

From NSW RTA website:

"There are licence suspension periods, similar to the minimum disqualification periods applied by a court, for exceeding the speed limit by more than 30 km/h (3 months)"

"More than 30 km/h but not more than 45 km/h 3 months (minimum)"

Can't you apply to be able to drive for work related journeys even though suspended if it would cause hardship (ie. you can't work)? I don't recall the legislation or process at the moment but know a couple of people who have done it.

Maybe worth remembering for the unfortunate few!

Eh? Let me get this right: Someone drives between 30km/r and 45km/r above the speed limit, gets clocked, fined and banned for 3 months - and you think that driver is unfortunate????

When my mate got done for just being of the drink driving limit, they let him go on a good behavour licence rather than take it off him altogether. this was basically because of his work (NSW BTW)

Not sure what you mean by this post. But if you look at what happend to me....

After 18 years of driving abouth 70,000 kms a year without a single point, accident, etc, I took a wrong turn in Sydney on a Sunday afternoon and ended up heading in to one of the tunnels, whist trying to work out how to get out, I missed that someone had turned on a 40 sign for no reason, taking the limit down from 70. Liek those that got refunded after the Lane Cover court case, there was no reason for the 40 sign.

I got done for doing 69..another 2km/h and I would have been banned for 3 months.

I'm happy to wear the fine and points, but would that really have deserved a 3 month ban and probably loosing my job?

lets face it 100ks on the highway is not exactly fast if thes not much traffic on i usually shoot up from brissie doin 180kh dont know wot that is in mph but seems safe enough to me

Yeah, me too - I heard that if you do more than 170 km/h, its too fast for the Roos to react and so they don't have time to jump out in front of you.

Just beware,... it may be in waiting for you.... I too have an idiot husband who last year got caught >45 kph (in fact "idiot" doesn't even begin to cover it!) he got slapped with a $1600 fine and was told by the policeman he could see that he was not a typical hoon and so would not be confiscating his licence there and then, he had the choice of paying the fine or taking it to court for appeal. Unsure of what to do we called our local police station and asked would there be a ban if we just paid the fine, our reply was no not if it wasn't taken from you then. So we paid the fine. Ouch. Hubbie continued to drive. About 2 months later we both recieved letters inviting us to renew our licences which we go to do, only to get there and them refuse to renew hubbies. He got a 6 month ban and 6 demerits...however the bizare thing that I could not understand was the offence had been committed 2 months previous yet they were going to let him continue driving for a further week until the existing licence expired then ban him. We had had no other correspondance from the RTA. I found it rather strange that they invite you to reapply, then ban you...but not until the following week?

It was a lesson well learnt.

I've done 190km/h in a Police car.
