Default Is this possible?

Last week our buyer decides having had the survey report for 4 weeks and contracts signed (but not exchanged) that he wants the front drains inspected for possible tree root damage ( we then have to put in a claim on our insurance as he wouldn't be able to) and then on Friday he goes into the estate agent and says he wants £1700 off the agreed price to pay for new gutters, vent in bathroon (not up to standard) and ventilation for heating.

As the contracts are signed already where do we stand as far as him negotiating a lower price?

We need to exchange by Wednesday otherwise we have to put everything back until middle of October as that is the soonest the removers can fit us in again. Don't want to send stuff until contracts exchanged.We have been so accomodating to this buyer bringing everything forward because of his solicitor being on holiday last week in Sept.

How much more stressful can it get?

I'm afraid that the fact that each side has signed their part of the contract means diddledy(sp?) squat until they are actually exchanged. Nothing is binding until actual exchange. You'll need to make up your own mind whether he's pulling a fast one and whether to call his bluff and say that the agreed price is what you'll accept, nothing less.

Sounds as if he's trying it on if you ask me. No doubt money has been spent by him at this point but if there is work to be done you could always simply offer to meet halfway. If he has already instructed his solicitor, got a survey etc then he may be reluctant to pull out and waste a few hundred if not more quid. Ultimately its up to you good luck!

When we put the house up for sale we put it up for £5000 less than valuation price for quick sale and also he got £4000 off asking price so I think he has actuaaly got a good deal from us already, comparing the price of our house and others similar he won't get one for any where near what he has got ours for.

Hi Nicola

It seems that everyone on BE has some problem or other either finding a buyer or actually completing!

We have not got our house on the market yet, but if I was in your position I would agree to meet them half way. You could also consider asking the estate agent to reduce your fees equivalent to the other half as quite a few people on here have had success with that. If the property goes back on the market it will cost them more to advertise etc or you could go with another agent so they are better to accept a lower fee than nothing at all.

Don't stress too much though as a lot of people seem to try and get the price dropped by about £10-£15k so £1700 is cheap!
