Default Aged Parent Visa application

If My Father in Law applies for a contributory aged parent Visa in the UK and is refused. Would he be able to apply again if he was in Australia visiting his daughter? .

He is 80 yrs old and all of his children are living in Australia so we are fairly sure he will get the visa. (our only worry is that he has class 2 diabetes)

Our idea is that if he is rejected, the first time, he will at least be able to come out for a couple of years. As he is so old we feel that he might only have a few years left and he is all alone in the UK now.

BTW he has not got the sort of money you need for a retirement Visa! although he would have enough to live ok and take out private medical.

Probably, as long as he was on an ETA - however such an application would be refused again fairly quickly. You only get into the queue after passing the health requirement (they assess it again before visa grant).

You'll only know by submitting a visa application. If he is in good health generally he's got a reasonable prospect of visa grant. Contributory Parent visas are normally processed quite quickly.

Our idea is that if he is rejected, the first time, he will at least be able to come out for a couple of years. As he is so old we feel that he might only have a few years left and he is all alone in the UK now.
If his PR application is refused on health grounds, then one option some of you may need to consider is returning to the UK for a period. Having Australian citizenship is invaluable for this kind of situation.

Any other possible strategy requires the advice of an experienced professional as there are a range of complications.
