Thanks for throwing a spanner in the works!

Can someone give a definitive answer?

Hows this? My brother rode a 125 over there legally on an english provisional no cbt, fully insured for 4 years. got stopped on quite a few occasions and no problem! why dont you just do the full licence before you go if you are that worried about it?

.... so you can ride a 125 in Spain on a full car licence? And since OP's asking about licences, can anyone just clarify the minefield that is
you can or you can't drive legally in Spain on a UK licence given that your UK address may or may not still be valid???

(I know there are plenty of other threads, thought it might usefully all be in an answer in this one though....sorry!)

Not quite, the only place a provisional is legal is UK.
So he was def not insured without a licence.
Don`t advise people to break the law.

You may get insured but that doesn't mean you are licensed.

As has already been pointed out, driving without a licence is now a mandatory 6 month jail sentence. UK provisional licences are NOT legal in Spain.

If the op is going to be in and out of Gib every day he has to take into consideration that he will be in direct contact with the Gib police and the spanish guardia every day. If he is driving on a UK provisional and he is resident then there is great potential for trouble. Most days the guardia don't bother but when it's a Spain hates Gibraltar day then he will be up to his eyes in it. IMHO
