I was dubious about the investor contract / flip agreement but have confirmation in writing many times from Roseberry that the flip exists and how it works. As they were my financial advisers and what they said to me was untrue can anyone advise whether I have a legal claim against them rather than trying to get a refund of my deposit from DUJA? To be honest I am more hacked off with Roseberry than DUJA. Any comments appreciated. Thanks

Duja know all about Roseberys..a huge amount of people bought as investments but have caught a cold.As its a property in Portugal my understanding is that they are bullet proof.
The agent who we bought our property through (Sunrise Homes) received 14,000 euro's commission 2 months after we had paid our deposit....so you know who's in the pound seats.
We were supposed to get 2,000 euro's towards furniture when we completed...never got it though,sunrise declared them insolvent.Wonderful.
The upside is that they are superb apartments in a very quiet residential area and not too far from the beach & bars.
We luv it there and no regrets

Thanks ptmatt. I'm pleased that it's working out for those who intended to purchase the apartments. Myself and a mate had no intention of doing that from the outset which Roseberry were well aware of and they advised us we would not have to purchase the property. I'm going to contact the local paper to see if they would be interested in my story. I have lots of things in writing from Roseberry. People need to be made aware of what Roseberry are doing.

I think you will struggle, as if you pay your deposit you are then contracted to buy it legally, read HERE or find your own buyer that wants to take it on.
Lots of people bought two or three thinking they would sell some to finance the first buy cost, but with the lack of buyers they have no chance.
They were unlucky, but that is the chance you took buying off plan, you can make a killing or get killed.

It seems to me they were all at It Roseberrys,Your Property Abroad,Haven they all gave the same promises,but i can only speak from my experience and Luis was the only one who sorted it out for myself and ever since i have moved into my property his team have done everything to help.

I am also thro' Roseberry who have lied thro' there teeth to get sales. I tried to flip one of my two apartments but Duja said there was no agreement eventually they agreed that i could put my second deposit onto my first apartment and pay the other 50% ( this was done thro' a lawyer and i have the e-mail to prove this) when my laeyer tried to arrange the rest off the payment up cropped another name on the Duja turnover list Luis Constantino who wouldn't let my lawyer complete even though we had an agreement thro' a lawyer saying we could complete this way. I even offered to pay part of the finders fee just to get into the apartment(once only) but he stood firm and went against the agreement we had. I have now booked a lnew lawyer to take Duja to court. All i wanted to do was purchase the apartment and Luis C. would not let us complete. The whole deal has been a joke.

Yes i am willing to get involved,but the only Companies who i blame is the ones who mis-sold the properties with false promises,as i have said Luis and his staff are the only ones who sorted things out for myself.

Now what I can say to you is you have taken the worst option and that is the legal option, specially with the legal documents that we have in our possession with regards to your contracts, but that is for the courts to decide not me , what I would suggest you as a friend to try to help you would be complete in one and talk to us to find a solution that is good for both sides I’m still here and I can help you at no cost I’m not a lawyer and they will charge you if they win or they lose so really they don’t care and specially at this time when there is not to many property contracts to do they will take any case to court to make a couple of Euros. Think about you and your money I will help you and you will be better off believe me I’m telling you that as if you was my friend or relative.

Duja had the properties built and obviously try and find buyers thru various companies who get a good commission.
A lot of people have been left in a bad position...and obviously want to minimise their losses
On phase 2 & 3 there are lots of apartments lying empty,presumably because buyers are trying to avoid completing.
Duja are a business and must have huge problems caused by the non completions.
The falling euro and the slow property market are not the fault of Duja..they
have fulfilled their obligation and built great apartments.
I would doubt if Duja are in a good position financially because of all the non completions..so its not surprising they want buyers to complete on the apartments they agreed to buy.
The Portuguese legal system is very slow and complex.I would only go down that road as a last resort...if you do it will take years before you get an end result.If you did win at court then expect Duja to appeal....and a few more years to wait.

hi barryand linda, we are on golf 3 and having read of your problems can only sympathise, We have had minor problems as everyone has but i would urge you to meet with luis and try to find a solution to your particular problem.
I hope you can find a solution and get the pleasure that we experience every time we can get their.

I have replied privately to Luis and have gone through every possible choice to solve this problem but in the end Duja promised us a deal and when we tried to finish the deal off through my bsoliitor luis stopped the transaction saying Duja have changed there minds. Luis didn't have the decency to reply privately to my e-mail.
Here's hoping as we woukld like to enjoy what we have invested in.
