Exclamation Help: H1 approved but court case pending

Dear all

I am basically from India but right now in UK on student visa. I completed my Masters in IT, waiting for my results. I got my H1 approved and my visa interview date in on 25th sept, 2004 in London. My concern is I got court hearing on 22nd sept, I am defending charges of assault. This will be my first trial in court. Before this I was arrested and fingerprinted but they released me on unconditional bail. Now other party has dropped the charges and hopefully case will be dropped on 22nd sept.

1) Should I mark YES under question 38 in form ds-156
2) And if case is dropped and I am not convicted, do I need to attach court papers with my form?
3) Or I just simply answer NO to all questions?

Please reply soon, I am really tensed about whole situation. Will they refuse my visa, if answer yes. To be very honest, I was at wrong place at wrong time. My university campus direct knew the entire situation that’s why he made other party drop all the charges against me. Please help me out.
