I always wonder how our aussie "celebs" manage to go to rehab in the US - how do they manage to get a visa when they state the reason they are going is for rehab? LOL.

buying and selling drugs or possession is illegal in most places ...using is not ..

So going for rehab, they are self-admitted drug addicts. Add to that they often have charges pending, and it's okay to get a visa? Surprises me is all - you'd think a junkie at rehab is quite likely to commit illegal acts, which presumably is what the US is trying to avoid.

I dont mean to be pedantic, but there isnt a video of Kate Moss snorting coke. There is a video of her snorting some kind of substance, which didnt lead to any conviction as it's not possible to prove that it was coke.

Firstly, there is no overall motive in any immigration legislation -- the passage of laws in the minefield of the Congress is the art of the possible rather than the application of logic.

Applicants with drug convictions can obtain non-immigrant visas after a waiver. There is no such waiver available for an immigrant visa save one exception: a single charge of the possession of a small amount of marijuana.

Hence, you can come following the waiver if you've got drug offenses. But there's no way you can get permanent residency. However, it's perfectly possible to live pretty permanently in the US without permanent residency given a suitable visa.

Hi:

FWIW, there IS a waiver for almost any ground of exclusion for a NON-immigrant visa. [The only things not waivable are terrorism and national security grounds if memory serves me correct]. I've done a few of these waivers.
