You won't be fined if you don't owe tax. So file it.

YAY! Until today, I was unaware that this one just got sent to the fiancee to bring to the interview. Thought it also had to be sent with the 129F, hence my confusion! This clears it up nicely.

The STATE Dept., through it's foreign consulates, issue the visas. The ball is in their court, now. Normally, they want to see the I-134 AND supporting documents. A tax return is only one form of a supporting document. Hence, a letter from an employer, bank, etc. Some consulates will ask for 1 or more years of tax returns - especially if the petitioner is self-employed. But, it is up to the individual consulates on what they will want to see.

So, the best method here would be to bring it all and let then let them decide in person.....

When the K-1 beneficiary files for AOS, again with INS, an I-864 is required. Three years of tax returns are required (to the best the of my knowledge).

Yep, Don, your reply is greatly appreciated! I understood the AOS process with the taxes but needed some clarification as it applied to the 129F. I guess that's what this board is for, and I do thank those that took time to respond. As I said, I'll try not to overlap threads when I post, and I am sorry for doing that. Didn't mean to ruffle anyone's feathers, particularly since I'm new here, and just looking for help like the rest of you.

Not a problem for me, but the original poster did not get his/her question
answered because you came in and hi-jacked his/her thread with your
question. Always start a new thread when you are ASKING a question. Not
getting on your case, just explaining how things work here. It all worked
out, I answered the OP's question and therefore no problems. Just for
future posting remember not to hi-jack.
