Yea I think it comes down to the individual. Personally I dont think I would want to risk what woudl happen if I got married on a VWP and then had to rush back to the UK in an emergency...getting back in could be interesting.

Ultimately as long as you are honest with immigrations then you are generally ok. Biggest trouble with VWP is you waive all rights to appeal....the POE officers decision is final no ifs, no buts, and if you get a tosser then you're in shite creak.

This is such a horribly grey area....

when my husband entered the US last fall we were not sure if we were going to get married, and if we did, WHERE we were going to marry. We were considering three countries (US, Holland and England) based on personal preference, guests, whatever.

when we DID decide to get married I had about ten days or so to pull everything together. We didn't get married in my city, we married somewhere I wouldn't have expected.

If USCIS wants to prevent marriages occurring in the US under the VWP the officers would have to ask "is there a significant possibility you might marry a US citizen while on your visit here?"

We did the "right thing" and my husband left BEFORE his I-94 expiry. We did the "right thing" and I filed DCF at a significant cost to myself.

Damn, do we ever need immigration law clarification in any reform, and we're not going to get it despite all of the bickering here about those who are cognizant of the issues and despite all the money and time wasted by politicians grandstanding in Washington.

You would not be able to do so until the AOS and AP had been filed and the AP granted. Which is a huge part of why we DCFd, as my husband wanted to go back to Holland before we could have possibly received AP. Even then, AP is no guarantee of being allowed to re-enter.... then again, nothing short of citizenship is a 100% guarantee!

All of this should be discussed with the OP by any competent immigration attorney!

It may have been spot on to the OP's current situation but not to say theres no problem without pointing out the potential pitfalls. Seriously the best advice to anyone for immigrations is "Consult a specialised immigration attorney".

Anyone giving advice on Jewish religious law usually ends with "CYLR: consult your local rabbi " it is the same thing.

If someone asks me for my experience, I'll give it; same for my opinion; but if they ask me for my *advice* I always say "consult a lawyer."

Not really. I did my immigration from a VWP without an attorney.
did it on my own.

nothing wrong with getting opinions of others is there?
we all dole out advice based on ones life experiences. the subject of immigration is not excempt from that.

However, if you take my advice and I was winding you up, and it leads you to a deportation cell, then that's youir own fault.........advice is as only as good as the amount is costs you.

However generally I find if you spout shitty advice on this forum (either usernet or here) then someone will tell you you're talking bollocks.

Nope nothing wrong with getting opinions...thats why it's best to use IMHO and DYOR etc as a qualifier generally. Then everyone is clear on the fact its just an opinion. People have been successfully sued for posting opinions that have been taken as fact before on t'internet.
