Hi,
I am UKC married to USC and we have just gone through I-130 and DS260 - about to book medical and got all the forms. Realised as my husband hasn't filed any tax returns since he has been here (10 years) this is going to cause an issue with the documents at the interview.
i have downloaded the forms F255 and 1040 to complete, the wiki page posted by britguy86 says it can be filed in London, which apparently now it can't and I need to send to Texas...just wondering how long it is likely to take. I am planning on sending the past 3 years only, along with a letter from him to explain he didn't realise - we are well below the thresholds where we would be due to pay anything to the US tax people anyway.
Anyone else been through a similar thing recently - how did you get on and is there anything I need to know.
Do I need to send the P60s for the past 3 years along with the completed forms?
Thanks

It doesn't really matter how long it takes for IRS to process everything. All you need is a photocopy of everything that was sent to IRS.
I'm sure you will need to include the year-end wage statement, yes.

My first question is why are you doing your husband's taxes? He should take responsibility for it!
Secondly, your husband is in quite a common situation where US expats have failed to file US taxes. Getting back into compliance can be tricky, particularly if there are un-declared foreign accounts and delinquent FinCEN forms. Take a look here for the IRS procedure.

According to the IRS your husband should use the streamlined procedures to minimise penalties for unfiled tax and/or information returns; including FBARs. There are several excellent US qualified tax advisers in London if you feel you need professional help.
