Default Selling on Etsy as a business

My husband and I have started seeing a financial adviser in the hope that we can actually save some money so he can retire before he's 80! He is on an E2 employee visa and I am on the E2 employee spouse visa, I have my EAD and work part-time at a school. Our adviser suggested I register to start my own business from home (just selling things on Etsy) in order to maximize our tax return.

Now I'm presuming I can't do this because we are on a visa and it's not one that gives permission to start a business. Can someone just clarify this? Would this be something I could do if I had a greencard instead?

Any help is much appreciated.

You have an EAD - you are authorized to work for anyone at all, including yourself. I don't believe you have any restrictions on starting a business and running it. Your husband, however, can't work for your company - since his visa is tied to his E-2 sponsor.

Cheers Ian! I think it's actually a home based business I need to apply for but that's something I'll look into further now I just wasn't sure if my immigration status allowed me to do it. My husband won't be having anything to do with it, just me trying to make something out of my hobby of sewing.

There's nothing "to apply for". People just start a home-based business and run with it. Depending on where you live, you might need a business license, but that's all... no application really, just pay the fee. Check with your town or county clerk for that info.

You have permission to work... your immigration status doesn't really enter into the equation!
